المستخلص: \ يسعى هذا البحث إلى التعرف على مفهوم صكوك السلم، وأهميتها الاقتصادية، وتطبيقاتها المعاصرة، كما تسعى إلى التعرف علي مفهوم البترول، وأهميته كمصدر من مصادر الطاقة في العالم المعاصر، وأتى هذا البحث لتسلط الضوء على استخدام صكوك السلم - كأداة تمويل معاصرة - في تمويل الاحتياجات التمويلية لقطاع البترول في الاقتصاد الفلسطيني، وقد توصل إلى أهم النتائج التالية: تعتبر صناعة الصكوك حديثة العهد عامة، وفي فلسطين خاصة، إذ نجد غياب البيئة القانونية والشرعية للصكوك غيابا كاملا، فضلا عن افتقارها لمؤسسات البنية التحتية السائدة لها، ومحدودية نشر ثقافة الصكوك بين أفراد المجتمع، بالإضافة إلى قلة الكوادر البشرية المؤهلة للعمل في هذه الصناعة، كما ثبت صلاحية استخدام صكوك السلم في تعبئة الموارد المالية اللازمة لتمويل قطاع البترول، إذ تفتح باب المشاركة الشعبية أمام الجمهور للمساهمة في بناء اقتصادياتهم هذا من ناحية، ومن ناحية أخرى عدم وجود إطار قانوني إداري ينظم عمل الهيئة العامة الفلسطينية للبترول، بالإضافة إلى مدى تأثير الانقسام الفلسطيني على قطاع البترول، وقد خلص إلى أهم التوصيات التالية: ضرورة العمل على سن التشريعات القانونية والشرعية، وإعداد اللوائح والتعليمات التي تنظم عمل إصدار صكوك السلم، وضرورة العمل على إنشاء المعاهد التعليمية التي تساهم في إعداد الكوادر البشرية اللازمة للعمل في هذه الصناعة، والقيام بعمل الندوات وورش العمل والمؤتمرات التي تساهم في نشر ثقافة الصكوك في المجتمع بالإضافة إلى إعداد قانون ينظم عمل قطاع البترول، وحث الهيئة العامة للبترول على دخول هذه الصناعة بهدف الاستفادة من السيولة النقدية الموجودة في الاقتصاد ومن ثم استخدامها في تغطية الاحتياجات التمويلية لقطاع البترول في الاقتصاد الفلسطيني.

This study seeks to identify the concept of the instruments of Alsalam, and economic importance, and applications of contemporary, also seeks to recognize the concept of petroleum, and its importance as a source of energy in the contemporary world, and then comes this study to shed light on the use of instruments of peace - as finance contemporary - in the financing of the financing needs of the petroleum sector in general, and in Palestine in particular, the study found the most important results of the following: the industry is instruments recent general, and in Palestine in particular, where we find the absence of the legal environment and the share of the instruments complete absence, as well as the lack of institutions supporting infrastructure her, and the limited spread the culture of instruments between members of the community, in addition to the lack of qualified staff to work in this industry, and the validity of the use of instruments of Alsalam in the mobilization of the necessary financial resources to fund the oil sector, as it opens the door of popular participation to the public to help build their economies on the one hand, and on the other hand the lack of a legal framework regulating the work of the administrative body of the Palestinian General Petroleum, in addition to the impact of the Palestinian division on the petroleum sector. The study concluded the most important recommendations of the following: the need to work to enact legislation and share, and the preparation of rules and regulations governing the work of the issuance of the instruments of Alsalam, and the need to work on the establishment of educational institutions that contribute to the preparation of human resources necessary to work in this industry, and do seminars, workshops and conferences that contribute to spreading the culture of the community instruments in addition to the preparation of a law regulating the work of the petroleum sector, and therefore urged the General Petroleum Corporation to enter the industry in order to take advantage of the liquidity in bridging the financing needs of the petroleum sector in the Palestinian economy.
