تهدف هذه الدراسة إلي التعرف علي مفهوم صكوك الاستصناع، وأهميتها، وأنواعها، وتطبيقاتها المعاصرة، كما تهدف إلي التعرف علي أهمية المشاريع العقارية ودورها في تحقيق التنمية الاقتصادية، وقد توصلت إلي أهم النتائج التالية: حيث تعد صناعة الصكوك حديثة العهد، إذا نجد غياب الإطار القانوني للصكوك، فضلاً عن افتقارها لمؤسسات البنية التحتية المساندة لها، ومحدودية نشر ثقافة الصكوك بين أفراد المجتمع، بالإضافة إلي قلة الموارد البشرية المؤهلة للعمل في هذه الصناعة كما ثبت مدى صلاحية استخدام صكوك الاستصناع في تعبئة الموارد المالية اللازمة لتمويل المشاريع العقارية، حيث تفتح باب المشاركة الشعبية أمام الناس للمساهمة في بناء اقتصادياتهم، وقد خلصت إلي أهم التوصيات التالية: ضرورة العمل علي سن التشريعات القانونية والشرعية، وضرورة العمل على إنشاء المعاهد التعليمية التي تساهم في إعداد الموارد البشرية اللازمة للعمل في هذه الصناعة، والقيام بعمل المؤتمرات التي تساهم في نشر ثقافة الصكوك، وحث المؤسسات القطاع العام والخاص علي دخول هذه الصناعة – كأداة تمويل – بهدف الاستفادة منها في توفير السيول النقدية لتمويل القطاع العقاري في الاقتصاد الفلسطيني.
This study aims to identify the concept of Sukuk Istisna’a. and its importance, types, and the contemporary applications, also aims to recognize, the importance of real estate projects and its role in economic development, The study revealed the following results: where the industry of recent instruments, as we find the absence of legal framework and legitimate and regulatory instruments complete absence, as well as the lack of institutions, the supported infrastructure, and the limitation of spreading the culture of instruments between members of the community, in addition to the lack of qualified human resources to work in the industry field on one hand, and on the other hand as proven of validity of the use of instruments Istisna'a in mobilizing the financial resources needed to finance real estate projects, where it allows popular participation for people to contribute in building their economies. The study concluded the most important recommendations of the following: The enactment of legislation and legal legitimacy, and the preparation of rules and regulations governing the work of Sukuk Istisna’a, the need to work on the establishment of educational institutions that contribute to the preparation of the necessary human resources to work in this industry, to conduct seminars and workshops Labor and conferences that contribute to spreading the culture of the instruments in the community, urging the institutions .of the public sector and the private sector to enter the industry - as a tool of contemporary finance - in order to take advantage of the provision of liquidity to finance the real estate sector in the Palestinian economy.
