تهدف الدراسة إلى التعرف على مفهوم صكوك المشاركة المتناقصة، وأهميتها، وأنواعها، وتطبيقاتها المعاصرة، والتعرف على مفهوم الوقف الخيري الفلسطيني، وأهميته، وأنوعه، واحتياجاته التمويلية، وكيفية تمويله من خلال صكوك المشاركة المتناقضة، وقد توصلت الدراسة إلى النتائج التالية، تعتبر صناعة الصكوك حديثة العهد عامة، وفي فلسطين خاصة، حيث نجد غياب الإطار القانوني والشرعي والتنظيمي للصكوك غيابا كاملا، فضلا عن افتقارها مؤسسات البنية التحتية المساندة لها، ومحدودية نشر ثقافة الصكوك لدى الجمهور، إضافة إلى قلة الموارد البشرية المؤهلة للعمل في هذه الصناعة هذا من ناحية، ومن ناحية أخرى ثبت صلاحية استخدام صكوك المشاركة المتناقضة في تعبئة الموارد المالية لتمويل مؤسسات الوقف، إذ تفتح باب المشاركة الشعبية أمام الجمهور للمساهمة في بناء اقتصادهم، وقد خلصت الدراسة إلى أهم التوصيات التالية، وهي ضرورة العمل على سن التشريعات القانونية والشرعية، وإعداد اللوائح والتعليمات التنظيمية، وضرورة العمل على إنشاء المعاهد، والمؤتمرات التي تساهم في إعداد الكوادر البشرية، ونشر ثقافة الصكوك، وحث مؤسسة الوقف الخيري الفلسطيني على دخول هذه الصناعة - كأداة تمويل - لغرض الاستفادة منها في تفعيل دور الوقف للمساهمة في تحقيق التنمية الاقتصادية والاجتماعية المنشودة.
This study aims to identify the concept of Sukuk diminishing and legitimacy, and its importance , types, and applications contemporary, to identify the concept of endowment philanthropy, and legitimacy , relevance , and AL-Waqf , the nature of their needs financing , how to take the advantage of the Sukuk A1 Musharaka A1 Mutanaqisa in financing and supporting cessation charity in Palestine. The study found the following results, industry Sukukis recent in general and in Palestine in particular , where we find the absence of the legal framework , the legal and regulatory Sukuk are fully absence, as well as the lack of institutions, infrastructure support it, and the limited spread to the culture of Sukuk among members of the community , in addition to the lack of qualified human resources to work in a Sukuk market , on the other hand, to prove the validity of the use of Sukuk diminishing in mobilizing the necessary of financial resources to support and to fund endowment charity in Palestine , as you open the door to public participation the whole community to help building their economies , the study concluded to the most important following recommendations, the need to work to enact legislation and legitimacy, and the preparation of rules and regulations that govern the operation of the Sukuk, the need to create educational institutions and conferences that contribute to the preparation of human resources which is necessary , and a culture of Sukuk in the community , and urge the endowment charity in Palestine to participate in this entry of the industry -as a financing tool - in order to take advantage of them in activating the role of the Palestinian charitable endeavours
