يتناول هذا البحث اللفظ والمعنى, وعلاقتهما في وصف الحكم الشرعي وفهم المقصدية, حيث تكمن أهمية هذا الموضوع في بيان أهمية اللفظ والمعنى عند الأصوليين من حيث النظر الفقهي, ذلك أن كثيرا من العقود والقضايا المعاصرة لا يمكن أن نحدد وصفها الشرعي, إلا من خلال تحديد لفظ العقد الذي أبرم من قبل المتعاقدين, والمقصود باللفظ في هذا البحث هو: الأداة الطبيعية الأصلية في التعبير عن الإرادة الخفية, وتدور الفكرة العامة هنا على: كيفية التعامل مع اللفظ والمعنى من حيث الاستدلال بهما في وصف العقد أو الواقعة. وقد خلص هذا البحث إلى جملة من النتائج لعل من أهمها: أن الإرادة اللفظية تشكل أداة التعبير التي يقوم على أساسها إعطاء الوصف الشرعي للواقعة أو العقد المبرم, وتحريرهما بحكم شرعي, من خلال النظر إلى الألفاظ المكوّنة للعقد أو الشارحة للواقعة, لحملها على أصل فقهي معتبر, كما أنَّ القصد والنية والباعث لها دور كبير في تكوين العقد وترتّب آثاره، لذلك كان للفقه حظ وافر في الاعتماد على الإرادة الباطنة (المعنى)، ولنا في فروع الفقه الإسلامي أمثلة ونماذج كثيرة على الاعتداد بالإرادة الباطنة أو المعنى
This research deals with the context and the meaning and their relation with the description of the Islamic judge and understanding their objectives. The importance of this subject refers to the importance of the context and the meaning before the fundamentalists due to idiosyncratic. Therefore, a lot of contracts and contemporary issues cannot be identified the legitimate description through defining the context of the contracts, which were concluded by the contractors. In this research, the context meaning is a natural approach in the original expression of the implicit will. The general idea is about how to deal with the context and meaning in terms of their Inference in the description of the contract or incident. The summary of this research as follows: The context will forms the expression approach that is based on the basis of the legal description of the incident or the concluded contract and to edit them by focusing on the constituting context or by explaining the incident of the contract in order to get a considerable jurisprudential origin. In addition, the intent, the purpose and the motive, have a significant role in the contract preparation and the consequent effects, as a result, it plays a significant role depending on the internal meaning.
