إن التعرف على الطريقة الشرعية والآلية الدستورية التي يصبح بها شخصاً ما رئيساً للدولة الإسلامية له من الأهمية القصوى ليكتسب رئيس الدولة مشروعيته وليعرف المسلمون أنهم اتخذوا طريقاً شرعيا في هذا الاختيار وليتجنبوا غيرها من الطرق التي يحاول الآخرون إتباعها وإسباغ الشرعية عليها، وحتى لا تسرق ثورات الشعوب وهي تبحث عن حكومات شرعية من قبل غير المؤهلين لتسنم سدة الرئاسة، وأتضح أن تفاصيل النظام السياسي قامت على فعل اجتهادي اتخذ كقاعدة شرعية مؤسسة لمبادئ دستورية سياسية، وإن تعدد الطرق والوسائل التي يتم بها تولية رئيس الدولة يكشف عن اختلاف كبير في الأفعال الاجتهادية. وتبين أن الطرق وفق نظرية أهل السنة تخالف المبنى والمبادئ التي اعتمدت فيها فالتجاؤهم إلى الإجماع كقاعدة أساسية هروباً من الأدلة الشرعية الأخرى التي لا تفيد إلا الظن كما يقولون، قد أوقعهم في محذور الظن الذي لم يرتضوه؛ لأن الإجماع يبقى دليلا ظنياً ولم يثبت بالتواتر النصي؛ لأنه لم يتحقق إجماع على الاختيار، ولا إجماع على كون الاختيار طريقاً للتولية. وأن هذه الطرق كلها لا تؤسس بنفسها لشرعية رئيس الدولة، وإنما أن يكون رئيس الدولة مأذونا له شرعاً بتولي هذه لرئاسة وتكون الطرق معبرة عن الرضا الجماهيري والقبول الشعبي لهذه الرئاسة فلا مجال للغلبة والقوة لتولي السلطة وإن كان يمتلك الإذن الشرعي فكيف بمن لا يمتلكه؟!.
