المستخلص: يظهر استقلال البلدية بترك أمر تسيير شؤونها المحلية لمواطنيها، ولما كان من المستحيل أن يجتمعوا كلهم في مكان واحد وبشكل مستمر لمناقشة أوضاعهم وأولويات منطقتهم، كان لهم أن يختاروا من يمثلهم نيابة عنهم في ذلك، لهذا يعد النظام الانتخابي الوسيلة الديمقراطية الأساسية في القيام بذلك، فبموجبه يختار الشعب ممثليه على المستوى المحلي، وله أهمية في ضبط قواعد الانتقاء واثر ذلك عن قدرتهم في ممارسة مهامهم في استقلالية، ومسالة اختيارهم يمر بمراحل مختلفة ومتواترة، فقد تم ضبطها بما يفضي إلى جعل نتائجها تمثل تمثيلا صادقا ومعبرا عن توجهات المواطنين في البلديات، وعليه فقد تتبعنا مراحلها بدء بالشروط الواجب توفرها في الناخبين والمترشحين، وصولا إلى توزيع المقاعد، وما يتوفر للأفراد والأحزاب من وسائل وأدوات لحماية حقوقهم السياسية وللحفاظ على مشروعية التصويت من جهة أخرى.

Accordingly, we have pursued its stages, starting with the conditions to be met by voters and candidates, to the distribution of seats, and the means and tools available to individuals and parties to protect their political rights and from another angle, to preserve the legitimacy of voting.
