|a تعتبر الخوصصة من المواضيع الحديثة التي تجسد أحد آليات الإصلاح الاقتصادي التي تهدف إلى تحقيق التنمية الاقتصادية، كما تهدف هذه الآلية إلى نقل القطاع العام إلى القطاع الخاص وبالتالي تقليص دور المرفق العام، وقد نتجت الخوصصة بسبب قصور الدولة في تغطية النفقات، وهذا ما يشكل خطرا - بحسب بعض الباحثين - على الهدف الذي نشأ من أجله المرفق العمومي ألا وهو تحقيق المصلحة العمومية، مما قد يخلق نوع من عدم التوازن في النظام الاجتماعي للدولة، لذا سنحاول من خلال دراستنا إثبات أو نفي الفرضية القائلة بزوال فكرة المصلحة العامة في ظل سياسة الخوصصة بناء على الأهداف التي سطرها المشرع في قانون 01-04 المؤرخ في 20/8/2001 المتعلق بالخوصصة.
