المستخلص: تكون هذا البحث من مبحثين، حيث تحدثت في المبحث الأول عن البدعة وحقيقتها، وبينت حكمها في الشرع مؤيدًا بالأدلة، ثم ذكرت أسباب الابتداع، وبينت أقسام البدعة من اعتبارات عدة، ثم تحدثت عن مجالها وهو العبادات غالبًا. وفي المبحث الثاني تطرقت أولًا إلى حقيقة الاستحسان، ثم تحدثت عن حجية الاستحسان كمصدر من مصادر التشريع عند الأئمة الأربعة وهو الاستحسان المبني على دليل الشرع لا على محض الهوى، ودعمت ذلك بأمثلة تطبيقية لمسائل وفتاوى تستند إلى الاستحسان. وأخيرًا توصلت إلى الخلاصة من البحث وهي الفرق بين البدعة والاستحسان.

This paper is comprised of two treatises: in the first treatise, the author has dealt with the concept of bid'ah (innovation or heresy), facts about heresy according to Islamic jurisprudence citing appropriate evidences. The author also elaborated on the causes of innovation in Islam, the different categories of bid'ah, and the scope in which bid'ah is perilously prevalent, especially in religious services and worships. In the second treatise of this paper, the author has tackled the concept of Istihsan (preference) in Islamic jurisprudence and cited facts about it. The author further cited proofs about the cogency of using istihsan (preference) as a source of jurisprudence and legislation as used by the four major jurist imams; this is the category of preference deeply rooted in jurist evidences that go back to sources of religion not to pure passion or whimsical thinking. Illustrations and examples of preference applications have been forwarded citing exemplar fatwas (religious edicts) based on istihsan. In the conclusion, the author summarises the differences between bid'ah (heresy) and istihsan (preference).
