المستخلص: تناولت هذه الورقة الصلة بين أدوات الاجتهاد للفقيه، ممثلة بفقه المقاصد والأولويات وفقه الواقع، وأبرزت أهميتهم للاجتهاد، كما أبرزت مقاصد الحج جملة، وخصت مقصد التيسير ورفع الحرج بالتفصيل، ودللت على قصد الشارع في جملة أحكامه إلى التيسير ورفع الحرج، كما استعرضت الدراسة مظاهر التيسير ورفع الحرج في عبادة الحج على الخصوص، حيث لم تفرض إلا مرة واحدة، وقرنت بالاستطاعة نصا، وكثير من أحكامها مبني على التخيير، والتخيير أساس التيسير، وتوسع النبي صلى الله عليه وسلم فيمن أخر أو قدم بقوله: افعل ولا حرج، إلى غيرها من المظاهر، كما استعرضت الدراسة جملة من التطبيقات المستندة إلى مقصد التيسير وأثره في تحديد الأولويات للحاج في واقعنا المعاصر، كأولوية الصدقة بتكاليف الحج للمحتاجين على حج التطوع، وأولوية الإحرام قبل الميقات عن الإحرام في الميقات عند التزاحم، وأولوية الدخول إلى الحرم من الجهة المتاحة دون قصد جهة بعينها، وأولوية ترك تقبيل واستلام الحجر والحجر الأسود عند الزحام، وأولوية صلاة ركعتي الطواف حيث تيسر، وأولوية إنابة الجهات المختصة بذبح الهدي عن ذبح الحاج بنفسه. كما استعرض البحث جملة من التطبيقات في الواجبات، استنادا إلى مقصد التيسير ورفع الحرج: كأولوية التوسعة في ملابس الإحرام للحاج، وأولوية التوسعة في وقت الوقوف بعرفة ليلا أو نهارا، وأولوية توسيع وقت رمي جمرة العقبة الكبرى، وأولوية توسيع وقت رمي الجمار أيام التشريق، وأولوية عدم اشتراط المبيت في منى لمن له عذر أو مشقة كبيرة، وأولوية ترك تكرار السعي، والجدير ذكره أن لهذه الأولويات مستندات نصية أو قياسية، عداك عن الناحية المقاصدية.

This paper discussed the relationship between the tools of ijtihad (extrapolation) for the Islamic jurist, represented by the jurisprudence of the purposes and priorities and the jurisprudence of the reality and it highlighted the importance of ijtihad (extrapolation). It also highlighted the objectives of pilgrimage briefly and mentioned the objective of facilitation and removing the obstacle in detail. This research paper reviewed the objective of the Sharia regarding all its provisions to facilitate and remove the obstacle as it was only implemented once. It was compared with the ability in terms of text. Many of its provisions are based on choice and the choice is the basis of facilitation. The Prophet (peace and blessings of Allah be upon him) showed more flexibility when he said: do it there is nothing wrong in it. The study reviewed a number of implementations based on the objectives of facilitation and its impact in determining the priorities of the pilgrim in our contemporary situation, such as the priority of giving charity from the expenditures of Hajj to the needy one compared to Voluntary Hajj , the priority of Ihram before the meeqaat compared to Ihram at the meeqaat when it is crowded. The priority of entering the Haram (Holy shrine) from the available direction without intending a particular direction, the priority of leaving the kissing and touching the stone and the black stone during when it is crowded, the priority of performing the two rak'ahs salah of tawaf with ease and the priority of appointing the competent authorities to sacrifice the animal on behalf of the pilgrim. The study also reviewed a number of implementations of compulsory tasks, based on the objective of facilitation and removing the obstacle: such as the priority of the expansion of the Ihram for Hajj, the priority of expansion at the time of staying at Arafah during night or day, the priority of extending the time of throwing the Great Jamara Aqaba, the priority of extending the time of throwing the stones during the days of Tashreeq, the priority of not compulsorily spending the night in Mina for those who have an excuse or great hardship, and the priority of not repeating the Sayi. It is worth mentioning that these priorities are backed textually or analogically, except for the aspects of the objectives (maqasid)
