المستخلص: This research work concentrates majorly on analysing the Islamic Legal measures of resolving and eradicating the abuse of actualizing the right of divorce and other rights related to divorce, and the study shall be carried out by shedding lights on the various rules and rights associated with the concept. The researcher shall look into the issues of divorce which is been misinterpreted and wrongly applied to oppress and deprive wives of deceased from having shares in the left properties of their husbands, which also transcends to the revocability of a divorce. The research also discusses how oppressions and arbitrariness affect some children rights, such as breastfeeding and nursing, in line with the exegeses of the scholars of Tafseer and the jurisprudential verdicts of the Jurists. The work will cut across the Islamic Legal measures of evaluating the individual and personal conditions and efforts in providing a lasting solution to the problems .

يتناول هذا البحث التدابير الشرعية لمعالجة التعسف في استعمال الحق في مسائل الطلاق والحقوق المتعلقة به، وذلك ببيان أكثر الحقوق المرتبطة بهذا الجانب ويقع فيها التعسف، ومنها حق الطلاق الذي قد يستخدم تعسفاً دون وجه حق، أو للإضرار بالزوجة لحرمانها من الميراث، وقد يقع التعسف في الرجعة كحق من حقوق المطلق، أو أن يقع في الحقوق التي لها صلة أكبر بالأبناء كحق الرضاع وحق الحضانة، وذلك ببيان ما ذكره المفسرون والفقهاء في كل منها، والتدابير التي وردت في الشرع لمنع التعسف في هذه الحقوق، والإجراءات التي سنتها قوانين الأحوال الشخصية للحد من استعمال صاحب الحق لحقه في غير ما شرع لأجله .
