|a يقدم هذا البحث دراسة تأصيلية لفقه الواقع في السنة النبوية المطهرة من خلال دراسة الأحاديث الشريفة التي ظهر فيها مراعاة واقع المكلفين والسؤال عنه والبحث فيه، حيث تم جمع هذه الأحاديث وترتيبها حسب ما تدل عليه في معالجة الواقع وفهمه. \nوقد تناول البحث تعريف فقه الواقع والاختلاف في مدلوله، حيث ترجح أن معناه العام يقوم على ضرورة فهم الواقع فهما صحيحا؛ وذلك حتى نصل إلى حكم شرعي صحيح من خلال دراسة المسائل الفقهية بشكل دقيق وإدراك أوصافها المؤثرة وتحقيق مناطها، ومن ثم تطبيق الحكم الشرعي عليها. \nوبين البحث أن فقه الواقع نشأ عند المتقدمين، ولكن المتأخرين ركزوا عليه، وذلك لأهميته في الوصول للحكم الشرعي بشكل صحيح. \nكما تطرق البحث لأهمية فقه الواقع، فهو شرط للاجتهاد والفتوى، كما تظهر أهميته في إدراك اختلاف الواقع وأثره في كيفية تنزيل الحكم الشرعي، وتحديد الأولويات والتدرج في تطبيق الأحكام الشرعية. \nكما بين البحث كيفية معرفة فقه الواقع من خلال دراسة الواقع بالوسائل المتعددة منها: معرفة واقع المكلف وخصوصيته، والاستعانة بالعلوم الإنسانية والوسائل الإجرائية، وكذلك الاستعانة بالأبحاث العلمية البحتة.

|f This research presents an inherent study of the jurisprudence of reality in the pure prophetic Sunnah through the study of the honorable ahaadeeth in which consideration of the reality of those who are responsible, asking about it and researching it. These ahaadeeth have been compiled and arranged according to what they indicate in the treatment and understanding of reality.\nThe research dealt with the definition of the jurisprudence of reality and the difference in its meaning, where it is likely that its general meaning is based on the need to understand reality correctly, so that we can reach a valid shari ruling by carefully studying the issues of jurisprudence, recognition of its effective descriptions and verification of its reference and then apply the Shari (legal) ruling. \nThe research shows that the jurisprudence of reality arose among the early scholars, but the latecomers focused on it, because of its importance in understanding the Islamic jurisprudence correctly.\nThe study also addressed the importance of jurisprudence of reality. It is a condition for independent opinion and fatwa (legal edict). Its importance can also be seen in recognizing the difference of reality and its impact on how the Sharia law is revealed, how the priorities had been set and how Sharia was gradually implemented.\nThe research also shows how to know the jurisprudence of reality through the study of it by multiple means: knowing the reality of the taxpayer and his characteristic utilization of humanities and procedural means, as well as purely scientific research.\nThis abstract translated by Dar AlMandumah Inc 2018.
