|a يأتي هذا البحث مرتكزا على فكرة أساسية وهي تحليل بعض مواد أحكام قانون المعاملات المدنية الاتحادي لدولة الإمارات العربية المتحدة رقم 5 لسنة 1985م؛ وذلك للوقوف على مقاربات بعض مواده المتصلة بعقد الوكالة والفقه الإسلامي.\nوذلك في محاولة من الباحث لإلقاء الضوء على قانون المعاملات المدنية الاتحادي؛ والذي تم سنه مرتكزا على مذاهب الفقه الإسلامي المعروفة وهي المالكية والحنابلة والحنفية والشافعية. وفي ظل تنوع مصادر الفقه الإسلامي عكفت كباحث على تحليل بعض المواد القانونية في التشريع الإماراتي والأحكام القضائية في محاولة الغرض منها تغطية أوجه الفراغ التشريعي أو تعديلها في بعض المواضع التي وقفت عليها، وذلك في مناح عديدة تتصل بتكييف عقد الوكالة وشروطه بالإضافة لتحليل موقف المشرع الإماراتي من قواعد الوكالة بالخصومة وانقضاء الوكالة ومقاربتهما بأحكام الشريعة الإسلامية.\nورغم صعوبة المخاض في الفقه الإسلامي لكن البحث فيها يكتسب أهمية بالنسبة لقواعد المعاملات المدنية، باعتبار أن الشريعة الإسلامية هي المصدر الرسمي الثاني لدولة الإمارات العربية المتحدة؛ مما أقتضى علينا الخوض في غمارها.\nوالله أسأل أن يأتي هذا البحث لوجهه خالصا؛ وتتحقق به الفائدة العلمية المنشودة للباحثين والمشتغلين في مجال القانون.

|f This research aims to analyze some of the provisions of the Federal Civil Transactions Law of the United Arab Emirates No. 5 of 1985, to identify the approaches of some of its articles related to the Agency contract and Islamic jurisprudence. \n\nIt is an attempt by the researcher to shed light on the Federal Civil Transactions Law, which was enacted based on the well-known Islamic schools of jurisprudence, namely Maliki, Hanbali, Hanafi, and Shafi. And in light of the diversity of sources of Islamic jurisprudence, as a researcher, I have tried to analyze some legal articles in the UAE legislation and judicial rulings in an attempt to cover legislative gaps or modify them in some of the areas that were discussed.\n\nAnd it was undertaken in many respects related to the adaptation of the agency contract and its terms, as well as the analysis of the position of the UAE legislator about the rules of the agency and the expiry of the agency and their approach to the provisions of Islamic Shariah.\n\nWith difficulties to engage in Islamic jurisprudence, research in it is important particularly about the rules of civil transactions, since the Islamic Shariah is the second official legal source of the United Arab Emirates. \n\nI ask Allah to make this research only for His good pleasure, and may it achieve the desired scientific benefit for researchers and those working in the field of law.\nThis abstract translated by Dar AlMandumah Inc 2018.
