The study concluded that negative decision closer to restricted power, it discretion, and if the first is originally, the second is a specific exception in the case of an administration which acted described with deviation in power, the study touched on many of jurisprudence and judicial matters and dealt with by discussion and analysis and spend accordingly, and reached many of the results that were received during this research. Finally, the study has recommended amending the text on the negative decision, vented his problems jurisprudence, and the judiciary, so that the system of management identifies specific period for the consideration of requests submitted to them, and have expiry without reply, as a decision by refusing, and thus determined by the statutory procedures to appeal against this decision, and without distinction between the with a positive decision, to disappear so negative decision from the legal system, and ends with him jurisprudence and judicial differences.

كشف البحث عن القرار الإدارى السلبى في النظام السعودى والقانون المصرى دراسة تحليلية مقارنة. واعتمد البحث على الدراسة التحليلية المقارنة للوقوف على الاتجاهات الفقهية والقضائية في موضوع البحث ومراجعة البحوث العلمية العامة والمتخصصة والأحكام القضائية المنشورة وغير المنشورة في القضائين السعودى والمصرى ذات العلاقة بالقرار السلبى. وجاء البحث في مبحثين، الأول كشف عن ماهية القرار السلبي والذى ينقسم إلى أربعة مطالب الأول منها عن مفهوم القرار السلبى، والثانى عن أركان القرار السلبى، والثالث عن تمييز القرار السلبى عن القرارات الإدارية الأخرى، وأخيراً المطلب الرابع عن نهاية القرار السلبى. أما المبحث الثانى فعن الرقابة القضائية على القرار السلبي والذي ينقسم إلى أربعة مطالب، الأول منها عن حدود الرقابة القضائية على القرار السلبي، والثانى يتناول إجراءات الطعن على القرار السلبي، والثالث عن أوجه الطعن على القرار السلبي وأخيراً الرابع عن منطوق الحكم في القرار السلبي. وخلصت نتائج البحث إلى أن القرار السلبي ينتج من صورتين هما رفض الإدارة اتخاذ قرار أو الامتناع عنه وكان واجباً عليها اتخاذه وفقاً للأنظمة واللوائح ومن خلال هاتين الصورتين يتحدد ركنا القرار السلبي وهما رفض الإدارة أو امتناعها عن اتخاذ قرار وكان ذلك القرار واجباً عليها اتخاذه وفقاً للأنظمة واللوائح. كُتب هذا المستخلص من قِبل دار المنظومة 2018
