المستخلص: يسعى القانون الجزائي إلى تحقيق العدل من أجل الحفاظ على استقرار المجتمع، ولأجل ذلك يتطلب تكريس المساواة بين أفراد المجتمع جميعا بتوفير الحماية الجزائية دون أي تمييز سواء بسبب الجنس أو اللون أو العرق أو اللغة، فهو يضع أحكاما عامة تسري على جمح المخاطبين بقواعده أيا كانت الجريمة، وأيا كانت صفة المتهم أو صفة المجني عليه، وتقتضي السياسة الجزائية في بعض الأحيان وضع أحكام خاصة بسبب صفة المتهم أو المجني عليه، ومن أهمها تلك التي تفرضها ضرورة مراعاة الخصوصية التي تتمتع بما المرأة كونها أنثى تتميز عن الرجل من الناحية البيولوجية أو الفيزيولوجية والدور الذي تقوم به في المجتمع، وهو ما يكرس احتراما ومراعاة لظروف واعتبارات خاصة، من أجل تفعيل مبدأ المساواة بين الجنسين.

The Penal Code seeks to achieve justice in order to preserve the stability of society. Therefore, the equality of all members of society must be enshrined in the provision of penal protection without any discrimination on the grounds of sex, color, race or language. It establishes general provisions applicable to all persons, regardless of the offence, regardless of the status of the accused or the victim. Penal policy sometimes requires special provisions on account of the status of the accused or the victim. Among the most important provisions are those imposed by the need to take into account the privacy that women enjoy as females, who are biologically or physiologically distinct from men and the role they play in society. This is what enshrines the respect of special circumstances and considerations to activate the principle of gender equality.

L e droit criminel vise à réaliser la justice pour maintenir la stabilité de la société, Cela exige de consacrer l'égalité de tous les individus en offrant une protection pénale sans aucune discrimination fondée sur le sexe, la couleur, la race ou la langue, il met les dispositions générales applicables à tous personne, quel que soit le crime, quel que soit le statut de l'accusé ou de l'état de la victime, et la politique pénal exige parfois des dispositions spécial en raison du caractère de l'accusé ou de la victime, parmi ces disposition les dispositions imposé par la nécessité de respecter la confidentialité de la femme distinct de l'homme physiquement biologique ou physiologique et le rôle qu’ elle le joue dans la société, en respectant ses circonstances et ses considérations particulières,ce qui donne l’efficacité au principe de l'égalité entre les sexes.
