|a تتناول هذه الدراسة بالتفصيل والتأصيل أحكام وثيقة الإشهاد المكتوب كوسيلة من وسائل إثبات الملك الوقفي من وجهة نظر تشريع الأوقاف الجزائري لاسيما أحكامها التي قررها المرسوم التنفيذي 2000- 336 ؛ المتضمن إحداث هذه الوثيقة وشروط وكيفيات إصدارها وتسليمها، إضافة إلى القرار الوزاري الصادر عن وزارة الشؤون الدينية والأوقاف في 26 مايو 2001. في هذا الإطار، تستعرض هذه الدراسة تعريف وثيقة الإشهاد المكتوب، خصائصها القانونية وشروطها الموضوعية والشكلية، إضافة إلى القواعد الإجرائية لإثبات الملك الوقفي عن طريق الوثيقة المذكورة؛ هذه القواعد التي تسمح عمليا بإثبات الوقف بهذه الوثيقة بدءا بأحكام إنشائها والتصديق عليها وتسجيلها، وانتهاء بإصدارها وتسليمها.

|b This study discusses m detail and rooting the provisions of the document publicity written as a means of King endowment prove from the point of view of Awqaf legislation of Algeria, in particular its provisions decided by the Executive Decree 2000 - 336; containing the creation of this document, and the conditions and clauses issued and delivered, in addition to the ministerial .decree issued by the Ministry of Religious Affairs and endowments in the May 26, 2001 In this context, this study examines the definition of document certification written, legal characteristics and conditions of the substantive and formal, in addition to the procedural rules to prove King endowment through the document in question; these rules that allow practically prove the cessation of this document starting with the provisions of its creation, ratification and registration, and the end of the issued and delivered.
