|a ترمى هذه الدراسة إلى تناول موضوع علاقة السلطة التنفيذية بالدور التشريعي للبرلمان في الجزائر، رغم أن المشرع الدستور من خلال المادة 98 من دستور 1996 التي منحت للبرلمان السيادة في إعداد القانون والتصويت عليه. إلا أنه في مقابل ذلك تبرز نفوذ السلطة التنفيذية معرقلة هذه السيادة وذلك بتحكمها في سير عمل البرلمان ومشاركة رئيس الجمهورية البرلمان في العملية التشريعية، وتعزيز دورها في المجال المالي الذي يعود للبرلمان، وغصب سلطة هذا الأخير وتحكم رئيس الجمهورية فيها أثناء الظروف الاستثنائية.

|d Cette étude vise à aborder le thème de la relation du pouvoir exécutif avec le Parlement en Algérie, malgré le fait que le législateur Constitution par l'article 98 de la Constitution de 1996 et notamment son article 98, accorde au Parlement le pouvoir de préparation et de vote des lois. Cependant, l’influence de l’exécutif obstrue cette souveraineté en contrôlant le fonctionnement du Parlement ainsi que la participation du Président de la République dans le processus législatif, et en renforçant son rôle dans le domaine du budget, qui revient au parlement, et en saisissant l’autorité de ce dernier ainsi que son contrôle lors de circonstances particulières.

|f The purpose of this study is to address the issue of the relationship of the executive branch with the legislative role of Parliament in Algeria, even though, through article 98 of the 1996 Constitution, which gave the parliament power to prepare and vote on the law. On the other hand, however, the influence of the executive branch is highlighted by its control over the functioning of the parliament, the participation of the President of the Republic in the legislative process, the strengthening of its role in the financial sphere that belongs to the parliament, and the usurping of the latter's authority and control of the President of the Republic during the exceptional circumstances.\nThis abstract translated by Dar AlMandumah Inc 2018.
