|f The legislator has criminalized the fact of misleading publicity as an unfair commercial practice in articles 28 38 of Act 04/02 on rules applicable to commercial practices. As a misdemeanor, it is among its pillars the material element, the latter, through the formulation of the article, consists of its presumed elements, and physical conduct. The presumed elements of the material element of this crime are, first, the need for commercial advertising and second, the capacity of the perpetrator to be economic aid. \nPhysical conduct is represented in three cases. The first is publicity leading to misinformation about your product or service. The second case: advertising includes elements that may lead to confusion with another seller or with its products, services, or activity, third case: when publicity relates to a particular offer of goods or services, while economic aid does not have a sufficient stock of those goods or cannot guarantee the services that normally have to be provided in comparison to the magnitude of advertising.\nThis abstract translated by Dar AlMandumah Inc. 2018

|d Le législateur a pénalisé la publicité trompeuse comme pratique commerciale déloyale par les articles 28- 38 de la loi 04/02.\nParmi les l’élément de cette infraction il y’a l’élément matériel, celui-ci est constitué par ses éléments présumés et les faits matériaux, dans les éléments présumés le législateur a exigé premièrement une publicité et deuxièmement la qualité de l’agent économique pour l’auteur de l’infraction.\nQuant aux faits matériaux, on a trois faits, le premier lorsque la publicité comporte des éléments susceptibles d’induire en erreur sur un produit ou un service, le deuxième: lorsqu’elle comporte la confusion avec un autre vendeur ou ses produits ou services, et le troisième fait: lorsqu’elle porte sur une offre de produits ou de services alors que l’agent économique ne dispose pas de stocks suffisants ou ne peut assurer les service qui doivent normalement être prévus par référence à l’ampleur de la publicité.

|a لقد جرم المشرع واقعة الإشهار التضليلي باعتبارها ممارسة تجارية غير نزيهة، في المادتين 28 38 من قانون 04/02 المتعلق بالقواعد الطبقة على الممارسات التجارية. وباعتبارها جنحة فإنها من بين أركانها الركن المادي، هذا الأخير من خلال صياغة المادة يتكون من عناصره مفترضة، والسلوك المادي.، فالعناصر المفترضة في الركن المادي لهذه الجريمة هي أولا ضرورة تحقق عنصر الإشهار التجاري وثانيا الصفة في الفاعل بأن يكون عونا اقتصاديا.\nأما السلوك المادي فيتمثل في ثلاث حالات، الأولى: الإشهار المؤدي إلى التضليل حول المنتج أو الخدمة، الحالة الثانية: تضمن الإشهار عناصر يمكن ان تؤدي إلى الالتباس مع بائع آخر او مع منتجاته أو خدماته أو نشاطه، والحالة الثالثة: عندما يتعلق الإشهار بعرض معين لسلع أو خدمات في حين أن العون الاقتصادي لا يتوفر على محزون كاف من تلك السلع او لا يمكنه ضمان الخدمات التي بجب تقديمها عادة بالمقارنة هم ضخامة الإشهار.
