|a أصبح امتلاك المسكن في الوقت الحاضر من الصعوبة بمكان بالنسبة لكثير من الأفراد نظراً لضعف قوتهم الشرائية كون تمويل العقارات السكنية تحتاج لتمويلها رؤوس أموال كبيرة مقارنة بتمويل المنقولات , و من هنا اهتمت الدول بنشاط التمويل العقاري , وقد انعكست هذه الأهمية على الصيغ التعاقدية التي يتم تمويل العقارات من خلالها شرائها أو بنائها أو ترميمها أو تحسينها , ومن بين الصيغ التعاقدية تلك هو عقد التمويل العقاري والذي يقوم فيه الممول بإقراض المشتري قيمة العقار الذي يريده من البائع أو المقاول الذي سيبنيه أو أن يدفع عنه الثمن مع حصوله على حوالة بحقوق البائع أو المقاول قبل المشتري الذي يقوم بتسديد قيمة القرض وتكلفة التمويل على شكل أقساط دورية بضمان رهن العقار أو الأرض المراد تشييده عليها , إذ يعد تمويل طويل الأجل يتناسب مع قدرة الفرد العادي ودخله , بخلاف أنظمة التمويل الأخرى التي أثبتت التجارب عدم تحقيقها الغرض والنتائج المطلوبة كونه قصيرة أو متوسطة الأجل.
