المستخلص: The President of the People's Municipal Assembly as the representative of the local administration - the municipality - and a manifestation of the consolidation of the principle of democracy cannot play the role assigned to him unless he has the legal and material independence to do so, which is a fundamental pillar of local governance. However, such autonomy may sometimes lead to abuse and impartiality from the legal framework, which imposes the need for a monitoring mechanism to avoid such limits. Here, the problem arises of reconciling the independence of the head of the People's Municipal Assembly to carry out his functions, with the need to be under the supervision of the guardian to ensure that he is not impartial in these tasks.

Le président du Conseil Populaire Municipal - en tant que représentant de l'administration locale (la mairie), et un aspect de concrétisation de la démocratie - ne peut accomplir les missions qui lui sont attribuées, sans qu'il détienne de l'autonomie juridique et matérielle, laquelle est considérée comme un élément fondamental pour la gestion des collectivités locales.
Cependant, ladite autonomie peut être mal utilisée ou déviée de son cadre légal, ce qui impose la nécessité d'instaurer un mécanisme de contrôle afin d'éviter des éventuels dépassements.
De ce fait, la problématique qui se pose est de rechercher l'équilibre entre l'autonomie du maire pour mener à bien ses fonctions d'une part, et l'impératif de lui soumettre à un contrôle tutélaire pour prévenir à l'abus de pouvoir d'autre part.

لا يمكن لرئيس المجلس الشعبي البلدي باعتباره ممثل الإدارة المحلية – البلدية- ومظهر من مظاهر تكريس مبدأ الديمقراطية القيام بالدور المنوط به ما لم تكن له من الاستقلالية القانونية والمادية ما يسمح له بتحقيق ذلك، والتي تعد ركنا أساسيا للتسيير المحلي.
غير أن هذه الاستقلالية قد تؤدى أحيانا إلي سوء استخدامها والحياد عن الاطار القانوني لها، الأمر الذي يفرض ضرورة وجود آلية رقابية لعدم تجاوز هذه الحدود. وهنا تثار إشكالية التوفيق بين استقلالية رئيس المجلس الشعبي البلدي للقيام بمهامه من جهة، وبين ضرورة خضوعه لرقابة الجهة الوصية لضمان عدم حياده عن هذه المهام من جهة أخري.
