المستخلص: Le phénomène des constructions illégales sur les terrains agricoles a connu une grande propagation suite à la réunion d’un nombre de facteurs dont les plus importants sont les conditions économiques et sociales. étant donné que ce phénomène constitue un vice grave qui emmène à l’épuisement du patrimoine agricole et à la déformation de l’image visuelle en exténuant les valeurs esthétiques dans ces milieux, le législateur algérien a confronté à ce dit phénomène en adoptant de nombreux mécanismes juridiques dont les uns sont à caractères préventif et les autres a caractère curatif et a chargé les autorités administratives et judiciaires à appliquer ces mécanismes et les rendre effectifs en vue de limiter la propagation de ce phénomène, les appareils administratifs les plus importants constituent en le contrôle administratif, tandis que l’appareil judiciaire s’est chargé de l’application d’un nombre de peines juridiques dont la plus importante est l’incrimination des auteurs de cette action.

عرفت ظاهرة البناء غير المشروع على الأراضي الفلاحية انتشارا واسعا نتيجة تضافر جملة من العوامل أبرزها الظروف الاجتماعية والاقتصادية، ولأن هذه الظاهرة آفة خطيرة تؤدي إلى استنزاف الثروة الفلاحية وتشويه الصورة البصرية بإعدام القيم الجمالية في هذه الأوساط تدخل المشرع للقضاء عليها من خلال وضع آليات قانونية عديدة منها ما هو ذات طابع وقائي، وأخرى ذات طابع علاجي، كما خول صلاحية تفعيل هذه الآليات بين الجهات الإدارية والقضائية للحد من هذه الظاهرة، وتتجسد أبرز الآليات الإدارية في الرقابة الإدارية، كما اضطلع الجهاز القضائي بمهمة تطبيق بعض الجزاءات القانونية أهمها تجريم مرتكبي هذا الفعل.

The phenomenon of illegal construction on agricultural lands has become widespread due to the combination of a number of factors, most notably the social and economic conditions. Since this phenomenon is a dangerous scourge that leads to the depletion of agricultural wealth and distortion of the visual image by executing aesthetic values in these circles, the legislature intervened to eliminate it through the development of several legal mechanisms. Some of them are of a preventive nature and others of a curative nature. It also authorized the activation of these mechanisms between the administrative and judicial authorities to curb this phenomenon. The most prominent administrative mechanisms are embodied in administrative control. The judiciary has undertaken the task of applying some legal penalties, the most important of which is the criminalization of the perpetrators of this act.
