المستخلص: عرف الاهتمام بحماية البيئة كحق إنساني تطورا كبيرا وأولوية ضمن مختلف الجهود الدولية والقانونية، والتي عكست وبشكل واضح طبيعة وجوهر المكانة التي يحظى بها الإنسان كصاحب حق في النظام البيئي، خاصة من خلال الاعتراف له بمختلف الوسائل والصلاحيات التي من شأنها المساهمة في تأكيد حقه في البيئة وممارسته، فضلا عن تقرير له مجموعة من الضمانات القانونية والقضائية الكفيلة بتمكينه من التمتع الفعلي بهذا الحق، غير أن هاته الضمانات غير كافية حتى يتحقق الإعمال الكامل للحق في البيئة، بل لابد أن يقترن ذلك بمجموعة من الضمانات الفعلية والواقعية، والتيتكفل الحماية له وترفع من فرص تمكين الأفراد وانتفاعهم الفعلي به، وهذا لا يكون إلا من خلال إشراك كافة الجهات والأطراف الفاعلة أصحاب الشأن في عملية التمكين والانتفاع بجميع جوانب وأبعاد هذا الحق، لخلق بيئة ذات نوعية تسمح لصاحبها بتبادل الآراء والإسهام بالخيارات في اتخاذ القرارات والتدابير البيئية على كافة المستويات.

Attention to environmental protection as a right Humanist know a great development and priority within the various international and legal efforts, which reflected clearly the nature and essence of the prestige enjoyed by thethe human right as an entrepreneur in the ecosystem, in particular through the recognition of him by all means and powers that will contribute to assert his right to the environment and practice, as well as a report that a group of legal and judicial guarantees which would enable the effective enjoyment of this right, but these circumstances the safeguards are inadequate until the full realization of the right to the environment is achieved, but must be combined with a range of actual guarantees and realism, and to ensure his protection and raise the chances of empowerment individuals actual doing and their access to, and this can only be done through the involvement of all relevant actors stakeholders in the process of empowerment and access to all aspects and dimensions of this right, to create a quality environment that allows its owner to exchange views and contribute to the choices in the decision-making and environmental measures at all levels
