المستخلص: إن من أروع وأشرف صور العطاء الإنساني، إن لم يكن أعظمها وأنبلها على الإطلاق، أن يصوغ إنسان أول وثيقة في التاريخ تطالب بحقوق الإنسان، وهو شاهد على ظلم الإنسان لأخيه الإنسان، في فاجعة انتهكت فيها أبسط حقوق الإنسان فضلاً عن تعاليم الإسلام وأحكامه، ووسط أجواء مشحونة بالأسى والحزن ومشبعة بألم الفراق والصدمة الشديدة، لما حصل لأهل بيته على أرض كربلاء من مجزرة بشعة يندى لها جبين الإنسانية وبتلك الكيفية التي تشمئز منها النفوس وتأنف منها حتى الوحوش الضواري، من قتل وتمثيل بالجثث وقطع الرؤوس، والتي لم يسلم منها حتى الطفل الرضيع؛ ألا وهي رسالة الحقوق التي شرعها الإمام زين العابدين عليه السلام بعد واقعة الطف، والتي تعد بحق أعظم وثيقة شاملة لحقوق جميع الإنسانية في العالم، وتعتبر لائحة قانونية وقاعدة أساسية فريدة من نوعها لبرمجة الحقوق المدنية والاجتماعية والسياسية في الإسلام.
وقد كان للطفولة – التي تعد حجر الأساس في بناء الأسرة، وعماد المجتمع وثروته الحقيقية- نصيباً في بنود رسالة الحقوق، حيث حدد فيها الإمام السجاد عليه السلام، وعلى وجه الدقة حقوق الطفل الواجب تنفيذها من قبل الأسرة والمربين والمؤسسات التعليمية، وكيفية تنشئتهم على الأخلاق الفاضلة، وغرس المبادئ والمثل السامية في أذهانهم منذ الصغر، معبرًا عن ذلك بكلمات بسيطة لكنها بليغة في معانيها عظيمة في مقاصدها ودلالاتها الخاصة، وكأن الإمام زين العابدين عليه السلام حين صاغ تلك الحقوق كان يستحضر في ذهنه صورة الطفل عبد الله الرضيع وهو بين يدي أبيه الإمام الحسين عليه السلام، مذبوحًا من الوريد إلى الوريد، واستشف من وراء الغيب أن عبد الله الرضيع لا زال مرفوعًا على الأكف مذبوحًا تشخب أوداجه دمًا، والمجرمون يرمونه بسهام الغدر والخيانة، في العراق واليمن وسوريا والبحرين وغيرها من البلاد الإسلامية وغير الإسلامية التي تنتهك فيها حقوق الأطفال كل لحظة وفي كل يوم.
لذا فإن حقوق الطفل وحمايته، وأساليب تنشئته المستوحاة من رسالة الحقوق للإمام زين العابدين عليه السلام، مع مقارنة بين ما ورد فيها بخصوص الطفل، وبين ما اقرته الاتفاقيات والمواثيق الدولية الحديثة للطفولة من حقوق، هي ما سوف تكون محور بحثنا هذا.


It is one of the most wonderful and honorable forms of human giving, if not the greatest and noblest of all, that a person formulates the first document in history demanding human rights, and he is a witness to human oppression towards his fellow man, in a calamity in which the most basic human rights were violated as well as the teachings and rulings of Islam, in the atmosphere filled with grief and sadness, and imbued with the pain of separation and severe trauma, For what happened to the people of his house on the land of Karbala of a hideous massacre that shocked humanity, and the way in which souls are disgusted even predatory monsters would have hated the killing and maiming of corpses and beheading, from which not even a baby was spared; It is the The Risalat al-Huquq (Treatise of Rights) that Imam Zain al-Abidin, peace be upon him, legislated after The Battle of Karbala, which is indeed the greatest comprehensive document for the rights of all humanity in the world, and is considered a legal list and a unique basic rule for programming civil, social and political rights in Islam.
Childhood - which is the cornerstone of building the family, the pillar of society and its real wealth - had a share in the articles of The Risalat al-Huquq (Treatise of Rights), in which Imam Al-Sajjad, peace be upon him, defined precisely the rights of the child to be implemented by the family, educators and educational institutions, and how to raise them on morality and to implant lofty principles and ideals in their minds from a young age, expressing this in eloquent but straightforward words with great meanings in their own intentions and connotations. As if when Imam Zain al-Abidin, peace be upon him, formulated these rights, he had in his mind the image of the infant Abdullah, who was in the hands of his father, Imam Hussein, peace be upon him, slaughtered from ear to ear. He realized from behind the unseen that the infant Abdullah was still raised on the palms slaughtered, and blood is flowing from his jugular veins, and criminals are throwing arrows of treachery and treason in Iraq, Yemen, Syria, Bahrain and other Islamic and non-Islamic countries where the rights of children are violated every moment and every day.
Therefore, the rights and protection of the child, and the methods of child upbringing inspired by The Risalat al-Huquq (Treatise of Rights) of Imam Zain al-Abidin, peace be upon him, with a comparison between the provisions contained therein concerning the child and the rights adopted by modern international conventions on children, will be the focus of our research.
