المستخلص: يعد حق الإنسان في بيئة سليمة من المبادئ المهمة التي تكرست في عدد من الدساتير الوطنية والوثائق الدولية، وقد بدأ الاهتمام بهذا الحق خصوصا بعد ظهور المشكلات البيئية وتزايد أخطارها، وقد ظهرت معالم الاهتمام بهذا الحق على الصعيد الوطني والدولي ولاسيما أن التقدم الصناعي والتكنولوجي أثر سلبيا في تمتع الإنسان بهذا الحق. وحق الإنسان في بيئته سليمة هو حق حديث النشأة، وهو حق زمني يؤدي الزمن دورا في تحديد مضمونه، وهو لا يخص الإنسان في الجيل الحاضر فقط بل في الأجيال المقبلة، وهو من حقوق التضامن، أي يجب تضافر الجهود كلها وطنيا ودوليا لاحترامه والدفاع عنه. وتدور إشكالية البحث حول العلاقة بين التنمية المستدامة ودورها في تقدم المجتمع تقنيا وصناعيا، وتأثيرها السلبي في بيئة الإنسان، إذ اتضح أن المزيد من التقدم يؤدي إلى المزيد من تدهور البيئة؛ لذلك جري العمل من خلال بعض الآليات لتحقيق نوع من التكامل والتوازن بين التنمية المستدامة من جانب وحق الإنسان في بيئة سليمة من جانب آخر. وتنقسم هذه الآليات إلى نوعين: آليات انفرادية وأليات تشاركية. وتتجلى الآليات الانفرادية في الضبط الإداري البيئي، فضلا عن النظام الجبائي البيئي. أما بالنسبة إلى الأليات التشاركية فهي: التخطيط البيئي، وأسلوب الأنظمة الجماعية لتعويض الأضرار البيئية، والجمعيات البيئية.

The right of the human being of living in a healthy environment has been adopted in many national constitutions and confirmed by international documents. This right became the issue of consideration upon the spread of pollution and its risks upon humanity. The concerns about the features of this human right appeared on both levels: national and international along with the spreading of pollution caused by both industry and technology. This pollution badly affects the right of individuals to live in a healthy environment. The right of an individual to live in a healthy environment is an emerging right. This right is a chronicled right as time influences its content. This right docs not concerns the human being in the present time only but it is the concerns of all future generations. Additionally, solidarity7 is an important factor as all national and international efforts should make joint efforts to defend and respect it. In the present legal research the relationship between the current industrial and technology development and its negative effects on the environment will be discussed. More industrialised societies could lead to the deterioration of the environment. Therefore, the elements that could establish the balance between industrial progress and a healthy environment should be found. These mechanisms are divided into two types: unilateral mechanisms and collective mechanisms. Unilateral mechanisms arc reflected In the environmental administrative control, in addition to the environmental tax system. As for the participatory mechanisms, these arc: environmental planning, and style collective systems to compensate for environmental damage, and environmental associations
