After the state function turned from the Guardian to the legal function, public prosecutor has become a job which received the attention of countries in the world by highlighting the state's role in protecting members of the community because of the work of criminals, who make up is always dangerous and worrying countries factor, and that the function of the Attorney General did not remain near to inner courts of the States only, but beyond it to the international criminal courts established after wars or crises before, and today this function is found in the international Criminal Court, which has established in order to protect the international community from Conception criminals and their crimes and bring them to justice. As this function formed a vital and important factor which we decided to highlight it in our research this through the statement of the national public prosecutor in terms of its origins and its role during the phases of the crime to punishment on the one hand, and on the other hand, we talked about the prosecutor and highlight the existence of at the international conventions and its role in stages of the trial of the criminals who make up their jobs threats and hurting peoples, begging from the investigation stage through trial and appeal the verdicts and decisions of international courts.
بعد أن تحولت وظيفة الدولة من الحارسة إلى القانونية، أصبحت وظيفة الادعاء العام احد أهم الوظائف التي لاقت اهتمام الدول في العالم من خلال إبراز دور الدولة في حماية أفراد المجتمع جراء أعمال المجرمين الذين يشكلون دوما عامل خطر ومقلق للدول، كما أن وظيفة المدعي العام لم يبقى لصيقا بالمحاكم الداخلية للدول فقط، بل تعدته إلى المحاكم الجنائية الدولية المشكلة بعد الحروب أو الأزمات سابقا، واليوم وجدت هذه الوظيفة في المحكمة الجنائية الدولية التي أنشأت من أجل حماية المجتمع الدولي من دنس المجرمين وجرائمهم وتقديمهم إلى العدالة. إذ شكلت هذه الوظيفة عامل حيوي ومهم والذي ارتأينا أن نسلط الضوء عليه في بحثنا هذا من خلال بيان الادعاء العام الوطني من ناحية نشأته ودوره أثناء مراحل الجريمة إلى العقوبة هذا من ناحية، ومن ناحية أخرى تطرقنا إلى المدعي العام الدولي وإبراز وجوده في صلب المواثيق الدولية ودوره في مراحل محاكمة المجرمين الذين يشكلون بأعمالهم تهديدا وآلاما بالشعوب بدءا من مرحلة التحقيق مرورا بالمحاكمة والطعن بالأحكام وقرارات المحاكم الدولية.
