المستخلص: تعتبر مسؤولية رئيس الدولة من أهم المواضيع الدستورية، خاصة في الأنظمة الجمهورية التي يخضع فيها رئيس الجمهورية للمسؤولية عن أفعاله ولو بصفة استثنائية، وبخلاف ذلك تتميز الأنظمة الملكية بعدم المسؤولية المطلقة لرئيس الدولة، نظراً لعدة اعتبارات، ولعل من أبرزها نجد المملكة المغربية، هذه الأخيرة يتمتع فيها رئيس الدولة (الملك)، بسلطات مطلقة، اكتسبها وفقاً لعدة اعتبارات تاريخية ودينية ودستورية، إضافة إلى أن الملك في المغرب يسود ويحكم، في مقابل ذلك كرست له هذه المكانة حصانة مطلقة ضد أي مسؤولية سواء كانت جنائية، أو سياسية، أو مدنية، وبذلك أصبح فوق كل نقد، بل تعدى ذلك حد تقديس شخصه وبنص الدستور.

La responsabilité de chef de l’état، est l’une des plus importants sujets constitutionnels, en particulier dans les systèmes républicains, qui dont le président de la république est soumis au de la responsabilité de ses actions et, même à titre exceptionnel, et par ailleurs les monarchies est caractérisée par l’irresponsabilité absolue de chef de l’état, en raison de plusieurs considérations, et peut être que le plus important , nous trouvons le royaume du Maroc, ou le roi a des pouvoirs absolus, qu’il a acquis selon diverses considérations historiques, religieuses et constitutionnelles, en plus le roi au Maroc, règne et gouverne, en revanche, il jouit d’une immunité absolue contre toute responsabilité pénale, politique ou civile. Et c’est ainsi en dehors de toute la critique, mais au delà de cela au point de la sanctification de sa personne dans la constitution.

The responsibility of the Head of State is one of the most important constitutional issues, especially in the republican regimes in which the President of the Republic is subject to responsibility for his actions, even on an exceptional basis. On the other hand, the monarchial systems are characterized by the lack of absolute responsibility of the Head of State, due to a number of considerations. It may be that the most prominent of these is the Kingdom of Morocco, where the Head of State (the King) enjoys absolute powers, which he acquired in accordance to several historical, religious and constitutional considerations. In addition, the King in Morocco is sovereign and governs. As a result, this status has given him absolute immunity against any responsibility, whether criminal, political or civil. Thus, he has become above all criticism, and indeed that goes traverses the limit of the sanctity of his person and by the text of the constitution.
