الحمد لله رب العالمين الصلاة والسلام على سيد المرسلين وعلى آله وأصحابه أجمعين. أما بعد -فإن من أهم مسائل علم أصول الفقه هي المباحث اللغوية، فيها توسع الأئمة المجتهدون في استنباط الأحكام الشرعية، وأثروا الفقه الإسلامي والمكتبة الإسلامية. والذي دفعني إلى الكتابة في هذه الجزئية -حجية مفهوم المخالفة – هو اختلافهم في مصدر ثبوته فمنهم من ذهب إلى أنها ثابتة لغة وذهب الآخرون إلى أنه ثابت شرعًا، وخلال عرضي للموضوع وبيان موقف علماء الأصول منها تبين لي أمران: الأول -إنهم اختلفوا في حجية مفهوم المخالفة وفي مصدر ثبوته، فذهب الجمهور إلى القول بحجيته وأنه ثابت لغة وإنه أسلوب من أساليب العربية، وذهب الآخرون إلى إنكار حجيته مطلقًا، وبعضهم قال ببعض أنواعه. وأن جمهور القائلين به اشترطوا للعمل به جملة شروط ليصح لهم الاستدلال به. والأمر الثاني -هو أن القيود المذكورة في النصوص الشرعية وغير الشرعية، قد تكون لأغراض وفوائد أخرى غير بيان الحكم، وأنه لا بد من البحث والاجتهاد في بيان الغرض منها.
