المستخلص: موضوع المقال يتمحور حول حق التمثيل السياسي للمرأة بين الإلزام القانوني والتباين الشرعي، حيث تناولت فيه نظام الحصص النسائية (الكوتا النسائية)، وأقسامه التي تتنوع على العموم إلى حصص إلزامية وأخرى اختيارية، وكذا المزايا التي يختص بها، ثم بينت مدى تطبيقه في الجزائر، التي اتبعت نظام سياسة الكوتا النسائية، وبخاصة بعدما صدر القانون العضوي رقم: 03/12.
كما تطرقت لمسألة عضوية المرأة في المجالس المنتخبة من منظور إسلامي، فكانت رؤى الفقهاء منقسمة في الموضوع إلى تصورين: أحدهما يجيز عضوية المرأة في المجالس المنتخبة، والآخر يمنع هذا الاشتراك.


The topic of the article revolves around the women's right to political representation between legal obligation and legal differences as it dealt with the system of quotas for women (women's quotas) and its sections, which generally vary into compulsory and optional quotas, as well as the advantages it has. It then explained the extent of its application in Algeria, which followed a system of women's quota policy, especially after the promulgation of Organic Law No. 12/03.
It also addressed the issue of women's membership in elected councils from an Islamic perspective. The views of the jurists were divided into two scenarios: one allows women to sit in elected councils and the other prevents such participation.

Cet article a pour objet le droit de représentation politique de la femme, entre l'obligation juridique et la déférence religieuse, on a abordé le régime du cota des femmes, sa typologie répartie en obligatoires et autres facultatifs, ainsi que les avantages de ce système et son application en Algérie notamment, après l'adoption de la loi organique 12/03.
On a traité également la question de la participation de la femme dans les conseils élus de point de vue du droit musulman, dont la doctrine est divisée a deux opinions controversées, l'une accepte cette participation, l'autre la rejette.
