المستخلص: بعد استقرار فكره الدولة ظهر نظام الجنسية لضبط شعبها وتمكنت الدولة من خلال هذا النظام من معرفة حدود ممارسة صلاحياتها واختصاصاتها المتعلقة بوطنيها وبأثر نظام الجنسية تمكنت الدولة التمييز بين الوطني الذي يدخل ضمن سيادتها الشخصية والأجنبية الذي يدخل ضمن سيادتها الإقليمية بعد دخوله أراضيها ولقد كان من نتائج ذلك ظهور التمييز في المعاملة بين الوطني والأجنبي في الحقوق والواجبات والقانون الواجب التطبيق أن هذا التمييز يرافق الأجنبي بمجرد دخوله إلى أراضي الدولة أي بمجرد وجوده خارج أراضي دولة جنسيته حيث سيواجه بإجراءات تبدأ بضبط دخوله لأراضي الدولة بواسطة نظام تأشيره الدخول الفيزا والذي ينطوي على مجموعة ضوابط وشروط تنظيمية يقتضي من الأجنبي استيفائها حتى يتمكن من الحركة بين محيط دولته ودولة أخرى.

Following the stability of the idea of the state, the nationality system emerged to control its people, and through this system the state was able to know the limits of exercising its powers and competencies related to its national territory. As a result of the nationality system, the State was able to distinguish between a national, which falls within its personal sovereignty, and a foreigner, which falls within its territorial sovereignty after entering its territory. One consequence of this is the emergence of discrimination in treatment between national and the foreigner in rights, duties and The applicable law is that such discrimination accompanies the foreigner once he enters the territory of the State, that is, once he is outside the territory of the State of nationality. He will face procedures beginning with the regulation of his entry into the state territory through the visa system. This involves a set of regulatory controls and conditions that the foreigner must meet in order to be able to move between the perimeter of his or her State and another State.
