The study dealt with the legality of the use of armed force during international intervention. The problem of the study represented in answering some questions: What is meant by armed force during international intervention? What types of armed force are used during international intervention? What is the legal basis for the use of armed force during international intervention? The importance of the study stems from the disclosure of cases in which the United Nations and regional organizations may gradually intervene in the sovereignty of States to the stage of forced intervention or coercive force taken in ensuring the use of armed force by international emergency forces, this is due to the cases of intervention in the international arena The study aims to identify the legality of the use of armed force and to identify models in which the use of armed force occurred. The study followed the analytical descriptive method to present the statement of legal texts, as well as the use of the comparative method to shed light on the rules governing international intervention. To achieve the objectives of the study, the study tested the following hypotheses: In accordance with the Charter, if international organizations were to use armed force, would have the positive effect of deterring States that violated international peace and security. Regional organizations can have the right to intervene in accordance with their Charter under the umbrella or flag of the United Nations. The use of the armed force by the great nations in a just manner will enable the establishment of international peace and security. The study found the following results: It is difficult to determine the content of the obligation not to intervene, or the reserved space of States, as a result of the lack of a precise standard. Full compliance with the principle of non-interference in all matters in the internal and external affairs of States is of paramount importance for maintaining international peace and security and for the realization of the purposes and principles of the Charter. The study concluded with several recommendations, the most important of which are: There must be a requirement that there be a commitment to military intervention to protect the citizens of the State abroad by the intervening State in good faith, on the conditions of necessity. The United Nations should look ahead to the legal basis for which the military intervention will take place and the real motives for the countries to resort to it.
تناولت الدراسة مدى مشروعية استخدام القوة المسلحة أثناء التدخل الدولي، تمثلت مشكلة الدراسة في الإجابة عن بعض التساؤلات وهي ما المقصود بالقوة المسلحة أثناء التدخل الدولي؟ ما هي أنواع القوة المسلحة المستخدمة أثناء التدخل الدولي؟ ما هو الأساس القانوني لاستخدام القوة المسلحة أثناء التدخل الدولي؟ تنبع أهمية الدراسة من الكشف عن الحالات التي يجوز فيها للأمم المتحدة والمنظمات الإقليمية التدخل في سيادة الدول بصورة متدرجة إلى مرحلة التدخل القسري أو القوة الجبرية الذي أخذه في تضمين استخدام القوة المسلحة بواسطة قوات الطوارئ الدولية وان مرد ذلك حالات التدخل إلى تشهدها الساحة الدولية، تهدف الدراسة إلى ضرورة التعرف على مشروعية استخدام القوة المسلحة، الوقوف على نماذج حدث فيها استخدام القوة المسلحة، إتبعت الدراسة المنهج الوصفي التحليلي لعرض بيان النصوص القانونية، وكذلك استخدام المنهج المقارن لتسليط الضوء على القواعد المنظمة للتدخل الدولي، ولتحقيق أهداف الدراسة اختبرت الدراسة الفرضيات التالية: وفقا للميثاق إذا انفردت المنظمات الدولية باستخدام القوة المسلحة سيكون له المردود الإيجابي بردع الدول التي تنتهك السلم والأمن الدوليين، يمكن أن يكفل للمنظمات الإقليمية التدخل وفقا لميثاقها تحت مظلة أو علم الأمم المتحدة، أن استخدام الدول العظمى للقوة المسلحة وشكل عادل يمكن من بسط السلم والأمن الدوليين، توصلت الدراسة إلى النتائج التالية: من الصعوبة تحديد مضمون الالتزام بعدم التدخل، أو المجال المحجوز للدول، نتيجة عدم وجود معيار دقيق، أن التقيد التام بمبدأ عدم التدخل بجميع أنواعه في الشئون الداخلية والخارجية للدول هو أمر ذو أهمية عظمى للمحافظة على الأمن والسلم الدوليين ولتحقيق مقاصد ومبادئ الميثاق، اختتمت الدراسة بعدة توصيات أهمها: يجب اشتراط أن يكون هنالك التزام للتدخل العسكري لحماية مواطني الدولة في الخارج من قبل الدولة المتداخلة بحسن نية، بشروط قيام حالة الضرورة، على منظمة الأمم المتحدة أن تطلع بشكل مسبق على الأساس القانوني الذي من أجله سيتم التدخل العسكري مما وحول الدوافع الحقيقية للدول للجوء إليه.
