المستخلص: The Human Rights Committee is considered one of the most active and influential committees. It is responsible for monitoring the implementation of the provisions of the International Covenant on civil and political rights. It performs multiple functions such as receiving reports of States parties to the Covenant and issuing concluding observations, receiving reports from individuals and expressing its views about it and adoption of General comments from real practices and jurisprudences concerning the application of the provisions of the Covenant by States parties. These general comments have received criticism and objections from a number of States, especially regarding the eligibility of the Committee to interpret the Covenant. As some of the States parties refused to have any legal value of these comments and looked at it as just a worthless legal statements and lacks to proper legal causation. Conversely, some found it as a formal explanation of the provisions of the Covenant. Undoubtedly the General comments of the Human Rights Committee which till now reached (35) (in addition to the draft concerned to general comment number 36 on the right to live) are of great importance, as the committee analyses the Covenant provision through these comments and provide legal interpretations which are coherent with the current international law and jurisprudence of the other committees monitoring the nine core human rights conventions. Also, it provides the States with suggestions of certain policies and practices seeking the improvement of the Covenant provisions effects on the national level. Thus, the impact it has on the application of the provisions of the International Covenant on Civil and political rights in national legal systems of States parties and on their legitimacy for these States has grown significantly. Furthermore, it plays an educational role for the members of the Committee itself, and to the States parties and international and national civil society organizations. Yet the role of these comments is not only inclusive to educational or guidance, but it goes beyond to the legal analysis of the provisions of the Covenant and their interpretation; it has become a tool to clarify the scope of the rights included in the International Covenant on Civil and political rights and the obligations of States parties arising from them. The Human Rights Committee invested these comments to consolidate its’ practices and jurisprudence. Thus, providing a solid legal explanations which fill many gaps and loopholes concerning the status of the recognized rights in the International Covenant on Civil and political rights. The pivotal question addressed in this research is from where these comments derive their legitimacy in international human rights law? And why the States should respect and accept them? The answer of this question relies in that all the contemporary law philosophy and international law are based on the theory of legitimacy; especially contemporary British law philosopher theory (Joseph Raz), and the theory developed by the pioneer American international law Professor (Thomas Frank). The main research hypothesis was that the legality of the General comments of the Human Rights Committee is not only derived from being accepted , respected and complied by the States parties as it will subjected to the will of these parties which weakens it. But, it is also derived from the cause quality, its harmony with the rules of international law, clear language, and the democratic preparation process and objectivity. And it is a criteria for evaluating the legality which constitute grounds reasons for the State to comply with the General comments. In other words, the basic premise of the research is structured on the notion that public comments derive their value and legal status from objective factors unrelated to the will of States parties such as their clear legally sound and logical content, the democratization preparation and conformation, the fact that it is compatible with international law provisions. The research has already sought to verify the legitimacy of the public comments through specific criteria linked to the formation process, and how to be adopted by the Human Rights Committee. Which is a democratic, transparent process and highly based on standards of accounting and accountability. The research results also showed that the General comments issued by the Human Rights Committee are guaranteed to be harmonious with the International Covenant system on Civil and political rights, and with the jurisprudence and practice of the Human Rights Committee and other committee’s jurisprudence on human rights and international law.

تعد اللجنة المعنية بحقوق الإنسان، وهي لجنة تعاهدية مكلفة بالرقابة على تنفيذ أحكام العهد الدولي الخاص بالحقوق المدنية والسياسية، من أكثر اللجان التعاهدية نشاطا وتأثيراً. وهي تنهض بوظائف متعددة من قبيل استلام تقارير الدول الأطراف في العهد وإصدار ملاحظات ختامية بشأنها، واستقبال بلاغات الأفراد وإبداء آرائها فيها، واعتماد تعليقات عامة من واقع ممارستها واجتهاداتها المتعلقة بوضع أحكام العهد موضع التطبيق من جانب الدول الأطراف. وقد حظيت هذه التعليقات العامة بانتقادات واعتراضات عدد من الدول، خاصة فيما يتعلق بأحقية اللجنة بتفسير أحكام العهد من خلالها. فمن الدول الأطراف من رفض أن يكون لها أية قيمة قانونية لهذه التعليقات ونظر إليها بوصفها مجرد تصريحات عديمة القيمة القانونية وتفتقر للتسبيب القانوني السليم. وبالمقابل، ثمة دول تري فيها تفسيرا رسميا لأحكام العهد. مما لا شك فيه أن التعليقات العامة للجنة المعنية بحقوق الإنسان التي بلغت حتى الآن (35) تعليقا عاما (بالإضافة إلى مسودة التعليق العام رقم 36 المتعلق بالحق في الحياة) لها أهمية كبيرة، فاللجنة تقوم من خلالها بتحليل أحكام العهد وتقديم تفسيرات قانونية تتناغم مع أحكام القانون الدولي النافذ واجتهادات اللجان التعاهدية الأخرى المعنية بالرقابة على اتفاقيات حقوق الإنسان الأساسية التسع. كما أنها تقدم للدول عبرها اقتراحات بسياسات وممارسات معينة بغية إنفاذ أحكام العهد على المستوى الوطني. لقد أضحت هذه التعليقات العامة تحظي بقبول واسع لدى الدول والفاعلين الآخرين من غير الدول كالمنظمات غير الحكومية العاملة في مجال حقوق الإنسان وباتت الدول الآن تسعى إلى الامتثال لما جاء فيها من تفسيرات. والسؤال المحوري الذي تصدى له هذا البحث هو من أين تستمد هذه التعليقات العامة مشروعيتها في القانون الدولي لحقوق الإنسان؟ وبالنتيجة ما هو مصدر احترام وقبول الدول لها؟ وللإجابة على هذا السؤال، جري الاستناد على نظرية المشروعية في كل من فلسفة القانون المعاصرة؛ وبالذات نظرية فيلسوف القانون البريطاني المعاصر (جوزيف راز)، وفي القانون الدولي العام؛ وبالأخص تلك التي طورها أحد رواد هذه النظرية في القانون الدولي وهو أستاذ القانون الأمريكي (ثوماس فرانك). وقد سعى البحث إلى التحقق من مشروعية التعليقات العامة من خلال معايير محدد ترتبط بعملية إعدادها، وصياغتها وكيفية اعتمادها من جابن اللجنة المعنية بحقوق الإنسان. فضلا عن معايير أخري تتعلق بمضمونها وتناغهما مع القانون الدولي الوضعي. وانتهي البحث إلى نتيجة أساسية وهي أن التعليقات العامة التي تتبناها اللجنة المعنية بحقوق الإنسان إن كانت تعد جزءا من "القانون الدولي الغض" (قانون قيد النشوء) إلا أن ذلك لا يعني أن تتصف بمشروعية غضة؛ فهي تتمتع بمشروعية عالية قادرة على إقناع الدول بمحتواها، وقبولها والعمل بما جاء فيها بغية ضمان الحقوق المعترف بها في العهد الدولي الخاص بالحقوق المدنية والسياسية في النظام القانوني الوطني للدول الأطراف
