المستخلص: تدور فكرة الدراسة الحالية حول تفعيل الحقوق التربوية للأطفال ذوي الاحتياجات الخاصة في ضوء مضامين الشريعة الإسلامية والتشريعات الوضعية. ولتحقيق هذه الغاية استهدفت الدراسة الحالية تحديد أهم ملامح الحقوق التربوية للأطفال ذوي الاحتياجات الخاصة في ضوء مضامين القرآن الكريم والسنة النبوية الشريفة، كذلك أهم ملامح تلك الحقوق في بعض التشريعات والمواثيق الوضعية الدولية فضلاً عن رصد واقع الحقوق التربوية للأطفال ذوى الاحتياجات الخاصة في ضوء القوانين والتشريعات المنظمة في ج.م.ع. وقد اتبعت الدراسة المنهج الوصفي التحليلي وفي نهاية هذا الطرح النظري والتحليلي تم تقديم مجموعة من المقترحات والتوصيات التي يمكن من خلالها ترسيخ حقوق الأطفال ذوي الاحتياجات الخاصة كما تضمنتها الشريعة الإسلامية والتشريعات الوضعية بالمؤسسات التربوية. أهم التوصيات والمقترحات: - إعادة صياغة فلسفة تعليم ذوي الاحتياجات الخاصة وأهدافه في جميع المراحل التعليمية. - التخطيط لتنسيق التعاون بين الوزارات المختلفة المعنية بتربية ورعاية ذوي الاحتياجات الخاصة. - وضع القوانين والتشريعات التي تحمي حقوق ذوي الاحتياجات الخاصة. - أن يكون التخطيط لتطوير تربية ذوي الاحتياجات الخاصة أحد المضامين الرئيسية للخطط الوطنية لتطوير التعليم.

The idea of the current study revolves around activating the educational rights of children with special needs in the light of the contents of Islamic law and the status legislations. To achieve this aim, the present study aimed at determining the most important features of the educational rights for children with special needs in light of the contents of the Holy Quran and the Noble Sunnah, as well as the most important features of these rights in some international legislations and charters as well as monitoring the reality of educational rights for children with special needs in the light of the contents of law and the status legislations in Egypt. The study followed the analytical descriptive approach. At the end of this theoretical and analytical presentation, a number of suggestions and recommendations were presented, through which the rights of children with special needs can be established, through Islamic law and the status of legislations in the educational institutions. The most important suggestions and recommendations: Paraphrasing the philosophy of educating students with special needs and its aims in all the instructional stages. Planning for coordinating cooperation among the different ministries that are interested in educating students with special needs. Issuing Laws and legislations that protect the rights of individuals with special needs Planning for developing the education of students with special needs should be one of the main content of the patriotic plans for developing education.
