المستخلص: The Algerian legislature has regulated the judicial investigation phase of juvenile delinquents with special criminal rules laid down in Act No. 15-12 on the protection of children as an important judicial stage. Given the sensitivity of this stage, the legislature distinguishes juvenile offenders in terms of treatment from adult offenders, considering that criminal proceedings under the Children's Act aim at correcting the behaviour of juvenile delinquents for their upbringing and protection. This raises the question of how the Child Protection Act regulates the stage of judicial investigation of juvenile delinquents, which requires the identification of the bodies charged with investigating this aspect. It also addresses the provisions and guarantees prescribed for juveniles during their investigation. The same will be discussed in this study.

Le législateur Algérien a organisé la phase d’enquête judicaire du délinquant juvénile avec des règles pénales spéciales prévues dans la loi no 15-12 relative à la protection de l’enfant. Cette étape est considérée comme importante car elle vise à identifier la personnalité du délinquant juvénile et les raisons derrière lesquelles il a commis l’infraction, afin de l’aider et de réhabiliter son comportement illégal. La question qui ce pose à cet égard C’est savoir comment la loi suscitée a organisé la phase d’enquête avec le délinquant juvénile, ce qui nécessite l’identification des personnes chargés d’enquêter en la matière ainsi que les dispositions et les garanties consacrés pour l’enfant délinquant.

نظم المشرع الجزائري مرحلة التحقيق القضائي مع الحدث الجانح بقواعد جنائية خاصة ضمنها في القانون رقم 15- 12 المتعلق بحماية الطفل باعتبارها مرحلة قضائية مهمة، ونظرا لحساسية هذه المرحلة فقد ميز المشرع المجرمين الأحداث من حيث المعاملة عن المجرمين البالغين، علي اعتبار أن الدعوي الجنائية في قانون الطفولة الجانحة تهدف إلي تقويم سلوك الحدث الجانح قصد تربيته وحمايته وهذا ما يدعو للتساؤل عن كيفية تنظيم حماية الطفل لمرحلة التحقيق القضائي مع الحدث الجانح الأمر الذي يتطلب تحديد الجهات المكلفة بالتحقيق في هذا الجانب وكذا التطرق إلي الأحكام والضمانات المقررة للحدث خلال التحقيق معه، وهو ما سوف يتم تناوله من خلال هذه الدراسة.
