|a يدرس هذا البحث: "قوادح العلة في القياس بين علم أصول الفقه وعلم الجدل"؛ وقد اشتمل البحث على مقدمة، وتمهيد، وأربعة مباحث، وخاتمة تشتمل على أهم النتائج والتوصيات. وظهر لي من خلال الدراسة والبحث عدة نتائج؛ من أهمها إجمالا: - أن علم أصول الفقه من أكثر العلوم المتعقلة بعلم الجدل والمتأثرة به، وأن الأصوليين من أكثر العلماء استخداما لعلم الجدل في تقرير القواعد الأصولية، والاحتجاج لها والدفاع عنها، ونقض شبه المخالفين. - أن علم الجدل أدخل على علم الأصول طرقا جديدة، كالحجج العقلية المتنوعة التي اعتمد عليها أكثر الأصوليين في تقرير مذهبهم، وهي طرق جديدة لم تكن معروفة في القرن الأول بين الصحابة والتابعين. - أن الجدل علم مستقل بذاته، وتأثر به كثير من علماء الأصول؛ وأثر ذلك في بعض الجوانب الموضوعية والمنهجية لعلم الأصول، فأصبح بينهما كثير من المسائل والفروع المتداخلة.

|b This study examines: "The invectives of the effective cause (Al-'llah) in the measurement between the fundamental of Jurisprudence (Usoul Alfiqh) and the science of controversy". The study included an introduction, a preface, four chapters, and a conclusion that includes the most important findings and recommendations. My research and study showed me several findings, and the most important of these are the following: - The fundamental of Jurisprudence is one of the most sciences that is related to the science of controversy and influenced by it. and that the fundamentalists (Al-Ousouliyeen) are considered the most scholars who used the science of controversy in determining rules, protesting and defending them repealing the suspicious of the violators. - That the science of controversy has introduced new methods to the fundamental of Jurisprudence, as various mental pretension which was adopted by many fundamentalists in the establishment of their mazhab (doctrine), they are new methods which were not known in the first century between the companions (Sahaabah) and those who followed them (Tabi'een). - That the controversy is a science of its own, and many of the jurisprudential scholars were influenced by it, and it has affected some substantive and methodological aspects of the science of Jurisprudence, so several issues and overlapping branches become between them.
