المستخلص: عاني الأطفال في ظل الأزمات والحروب ظروف مجتمعية صعبة وهم ضمن عرضة للاستهداف أكثر من البالغين لأنهم ضعفاء ومعالون ومعرضون لانتهاكات خطيرة من فما هؤلاء الأطفال هم أطفال الشوارع وهؤلاء لحاجة إلى حماية خاصة، حيث يتعرض هؤلاء الأطفال في مختلف أنحاء العالم إلى مخاطر جسمية ويقومون بأعمال كثيرة شاقة وخطرة ومخالفة للاتفاقيات والتشريعات القانونية والدولية والتي تنص على حمايتهم من الاستغلال ومن أداء أعمال تتعارض مع تكوينهم الجسمي وتعليمهم وتضر بصحتهم نموهم. والطفل بريء غير قادر على الدفاع على نفسه فهو بحاجة إلى حماية قانونية وأيضا حماية الطفل في قانون العمل وحقوق الطفل في الحماية الاجتماعية، وقد شرعت القوانين التي تحمي الطفولة والأطفال. إن أغلب أطفال الشوارع ضحايا الحرب والإرهاب والعنف الذي حطم المجتمع وفكك الكثير من الأسر ومن المعيب أن يتحمل هؤلاء الأطفال هذه الأخطاء ويتركون في الشارع يبحثون عن لقمة عيشهم بلا مأوى، ويكونون صيدا سهلا للإرهاب والعصابات المنظمة. وهنا يأتي دور المشرع في إصدار القوانين والاتفاقيات والمعاهدات لحمايتهم. وهناك العديد من القوانين والتشريعات الوطنية والدولية تؤكد على حماية الطفل وإعطاء حقوقه بالكامل وتوفر الحماية القانونية له (ضمن قانون العقوبات) وحقوق الطفل، وقانون رعاية الأحداث وضمانات حماية الحدث (ضمن قانون العقوبات) ورعاية القاصرين وحماية أموال القاصرين. وهنا حقيقة لابد لنا أن نقول: كان العراق في عام 1970 واحداً من أفضل البلدان في الشرق الأوسط وشمالي أفريقيا في رعاية وحماية الأطفال لكن سبب عقود الحرب والإهمال والويلات التي مر بها أصبح من أسوء البلدان. لذا نطمح من خلال الدراسات وهذه المؤتمرات أن نرتقي بالطفل والطفولة ونعمل على الحد من هذه الظاهرة (أطفال الشوارع) ونأخذ بيدهم ونضعهم على الطريق الصحيح السليم.

Children in crisis and war have suffered difficult social conditions and are more likely to be targeted than adults because they are vulnerable, dependent, and vulnerable to serious violations. Among these children are street children who need special protection. In various parts of the world, these children are exposed to physical hazards and perform much difficult and dangerous work in contravention of conventions and legal and international legislation that protects them from exploitation and from performing work that contravenes their physical composition, education, and harms their health and growth. Children are innocent and unable to defend themselves. They need legal protection and protection of children in the Labor Code and the rights of the child to social protection. Laws protecting children and children have been enacted. Most street children are victims of war, terrorism, and violence that have devastated society and disintegrated many families. It is a shame that these children bear these mistakes and are left on the street looking for a living without shelter and are easy hunting for terrorism and organized gangs. Here comes the role of the legislator in issuing laws, conventions, and treaties to protect them. Numerous national and international laws and legislations emphasize the protection and full rights of children and provide legal protection (within the Penal Code), the rights of the child, the Juvenile Welfare Act, the Juvenile Protection Guarantees (within the Penal Code), the care of minors and the protection of the property of minors. Here is the fact that we must say: in 1970, Iraq was one of the best countries in the Middle East and North Africa to care for and protect children, but because of decades of war, negligence, and misfortune it has become one of the worst countries. Therefore, through studies and these conferences, we aspire to raise children and childhood and to reduce this phenomenon (street children), take their hand and put them on the right path.
