God has created clean nature, in which everything is devoted for human as God successor in the earth. But human has been harming the earth which subjects to continuous deterioration. Environmental pollution is considered is the most prominent images grave damage. The world's attention is getting more day after day to the problem of environmental pollution because of its close association with the lives of human, animal and plant, that urges us to research in this problem to identify the tort liability due to the environmental pollution, to identify to what extent that tort liability is sufficient to indemnity pollution victims through the presentation of the basis of tort liability arising from environmental pollution and their properties corners, and to evaluate the compensation resulting from that tort liability and their obstacles, with focus on the benefits of the experiences of the other countries in this regard. And finally, the researcher presents the study conclusion which consists of the most important findings and recommendations. So we hope to live in clean and balanced environment in Palestine and protect it for present and future generations.
خلق الله الكون نظيفا، وسخر كل ما فيه للإنسان الذي استخلفه في الأرض، وما لبث هذا الإنسان أن أصبح يؤثر على البيئة ويغيرها، إذ تعيش اليوم تدهورا مستمرا، ويعد التلوث البيئي أبرز صور المساس بالبيئة والاعتداء عليها، ويزداد اهتمام العالم بمشكلة التلوث لارتباطها الوثيق بحياة الإنسان والحيوان والنبات، ما دفعنا للبحث في المسؤولية التقصيرية الناشئة عن التلوث البيئي، وبيان مدى كفاية هذه المسؤولية للحكم بتعويض ضحايا هذا التلوث من خلال عرض أسس المسؤولية التقصيرية الناشئة عن التلوث البيئي وخصوصية أركانها، وشكل التعويض المترتب على قيامها والصعوبات التي تواجهه، مع حرصنا على الاستفادة من تجارب الدول الأخرى في هذا الصدد، وصولا إلى خاتمة البحث التي اشتملت على أبرز النتائج والتوصيات التي توصل إليها الباحث، والأمل يحذونا نحو بيئة فلسطينية متوازنة ونظيفة وحمايتها من أجل أجيال الحاضر والمستقبل.
