Through the presentation of the concept of the environment in international law and its relationship to development and to review some of the advanced legislation and then was the statement of the effects of war on the environment and addressing these effects by international humanitarian law, and the role of non-governmental organizations in humanitarian law and international conventions to protect the environment, and the importance of the US role has been accessed violations and abuses the United States environmental Protection rules. تكمن أهمية دراسة البيئة والتنمية في ظل القانون الدولي الإنساني لما تتعرض له الدول النامية من تهميش عالمي تقوده الدول الصناعية الكبرى بإعادة نشر صناعاتها الملوثة للبيئة في مناطق الجنوب النامي تحت مسميات المساهمة في تنمية البلدان النامية، وفي هذا الإطار لا بد لنا من تناول متطلبات حماية البيئة في ظل القانون الدولي الإنساني والجهود التي تبذل من اجل ذلك وخاصة في زمن ووقت الحروب والنزاعات المسلحة. وحيث ان العلاقة الوثيقة بين كل من القانون البيئي الدولي والقانون الدولي الإنساني ونطاق الحماية التي يبسطها كل منهما على الإنسان وموارده تستدعي أن يسيرا في مسار متوازن يحقق للإنسان حماية حياته وحريته وظروفه التنموية ويحافظ على موارده وعلى التنمية المستدامة لهذه الموارد دون أي إهدار لها في وقت الحرب كما هو الحال في وقت السلم بما يمكن ان يخفف من عناء البشرية الناجم عن المشكلات البيئية. وهذا التوازي المنشود هو ما تم التعرض لدراسته من خلال هذا البحث وعبر السطور التالية. من خلال عرض لمفهوم البيئة في القانون الدولي وعلاقتها بالتنمية واستعراض بعض التشريعات المتقدمة وبعدها تم بيان اثار الحروب على البيئة ومعالجة هذه الأثار من قبل القانون الدولي الإنساني، ودور المنظمات غير الحكومية في القانون الإنساني والاتفاقيات الدولية في حماية البيئة، ولأهمية الدور الأمريكي تم عرض خروقات وتجاوزات الولايات المتحدة لقواعد حماية البيئة. ثم تم عرض نتائج البحث في الخاتمة.
