المستخلص: The study deals with the exploitation of the financial rights of the author by the electronic publishing contract that accompanied the emergence of developments in the field of information, especially the emergence and development of the internet and relying on the completion of electronic transaction Where the contract is through the contract between the author and the electronic publisher to spread the intellectual effort of the author by electronic means through simple publishing and interactive and other means that are conducted through the internet and to highlight the effectiveness of these means in achieving their purpose This study also shows the obligations imposed by this contract on both the author and the publisher in terms of the author handing over his work and correcting it and ensuring personal exposure by him or by third parties and the publisher in return to fulfill his obligation by paying the author and respect for his material and moral rights At the end of the research, the reason for the termination of this contract were reached in particular in accordance with the intellectual property laws that it regulates in a to the general reasons for its termination imposed by the general rules of contract

يتناول البحث موضوع استغلال الحقوق المالية للمؤلف بواسطة عقد النشر الإلكتروني الذي رافق ظهور التطور الحاصل في المجال المعلوماتي، لاسيما ظهور وتطور شبكة الانترنت، والاعتماد عليها في إنجاز التعاملات الإلكترونية. حيث يتم العقد، من خلال التعاقد بين المؤلف والناشر الإلكتروني لنشر المجهود الفكري للمؤلف بالوسائل الإلكترونية، عن طريق النشر البسيط والمتفاعل وغيرها من الوسائل التي تتم عبر شبكة الانترنت، وتسليط الضوء على مدى فاعلية هذه الوسائل في تحقيق غرضها. كما بينت هذه الدراسة، الالتزامات التي يفرضها هذا العقد على كل من المؤلف والناشر من حيث قيام المؤلف بتسليم عمله المتفق عليه وتصحيحه وضمان التعرض الشخصي من قبله أو من قبل الغير، وقيام الناشر بالمقابل بالوفاء بالتزامه من خلال دفع الجعل للمؤلف واحترام حقوقه المادية والمعنوية. وفي نهاية البحث تم الوصول إلى الأسباب التي ينتهي فيها هذا العقد بشكل خاص وفقا لقوانين الملكية الفكرية التي تنظمه، إضافة إلى الأسباب العامة لانقضائه والتي تفرضها عليه القواعد العامة للعقود.
