المستخلص: This study aims at identifying the legal system of flexible working contract; which was done through an introduction and three chapters, and a descriptive and analytical approach. In the first chapter, the concept, characteristics and forms of flexible working contract were discussed, the second chapter discussed the categories included within the flexible working contract and in the third chapter, the effects of flexible working contract were discussed. This chapter clarified the legal nature of the flexible working contract as well as the employee and employer's liabilities. Several results were concluded, one of the most important ones are that the provisions of traditional work contract are all applicable on the employee in the flexible working contract concerning the rights of the employee and employer and the employee and employers' liabilities with the presence of some kind of privacy related to the work risks' protection that must be available in regard to physical and health protection, how to provide this protection and the feasibility of control provision over the workplace by official entities. Other concluded results were that the flexible work system has established new opportunities to employ and preserve people with specific needs in specific places, where this system provides job opportunities for skilled- people with specific needs that cannot go to work due to their disability. This system is considered a new style to create a good environment in order to employ people with specific needs. The researcher made many recommendations, one of the most important ones are activating the role of media, schools and universities in order to spread flexible working culture and its role in society, qualifying and training the officials in governmental and private institutions on the flexible working as a new style that needs specific awareness from the administration which differs from the administration's traditional style, especially for remote-employees.
