المستخلص: يعنى هذا البحث بدراسة استقلال القضاء في الدولة الإسلامية وخطورة تأثير الحاكم عليه، ويهدف إلى توضيح أهمية استقلال القضاء في الدولة الإسلامية، وبيان أسبابه ودوافعه وأساليبه، واثر ذلك في تحقيقه، وأهميته في إقامة العدل، وإحقاق الحق، وحماية النظام القضائي وحصانته من الحكام والأمراء والمتنفذين وغيرهم؛ لثلا يعبثوا في شئون القضاء وما يتعلق به. فالقضاء نبض المجتمع ورمزه وعنوانه، به يعم الاستقرار وترد الحقوق إلى أصحابها، وتتحقق الطمأنينة، ويسود العدل، ويعتبر استقلال القضاء مقصدا من مقاصد الشريعة الإسلامية، وإذا تدخل الحاكم في القضاء أذهب هيبته، وأشاع الفوضى، وعم الظلم، وهدد أمن المجتمع واستقراره، وعليه فلا بد للمحافظة على القضاء من إنشاء هيئة رقابية تحافظ على استقلاله وتمنع أي تدخل في شئونه أو التأثير عليه.

It aims to clarify Importance Independence of the judiciary In the Islamic state, And the statement of his ways and his motives and methods, And its impact on the achievement of independence of the judiciary, which the administration of justice, And the realization of the right, and the protection of the judicial system and immunity of the rulers and princes and influential and others lest mess in the affairs of the judiciary and respect him. The judiciary is the pulse, symbol and title of society, Through it there is stability and rights are given to the owners, Reassurance is achieved, justice prevails, The independence of the judiciary is one of the purposes of Islamic law, If the ruler intervenes in the judiciary, go his prestige, create chaos, spread injustice, and threaten the security and stability of society, and therefore it is necessary to maintain the judiciary by establishing a supervisory body that maintains its independence and prevents any interference in its affairs, Or influence him.
