|a يعنى هذا البحث بدراسة استقلال القضاء في الدولة الإسلامية وخطورة تأثير الحاكم عليه، ويهدف إلى توضيح أهمية استقلال القضاء في الدولة الإسلامية، وبيان أسبابه ودوافعه وأساليبه، واثر ذلك في تحقيقه، وأهميته في إقامة العدل، وإحقاق الحق، وحماية النظام القضائي وحصانته من الحكام والأمراء والمتنفذين وغيرهم؛ لثلا يعبثوا في شئون القضاء وما يتعلق به. فالقضاء نبض المجتمع ورمزه وعنوانه، به يعم الاستقرار وترد الحقوق إلى أصحابها، وتتحقق الطمأنينة، ويسود العدل، ويعتبر استقلال القضاء مقصدا من مقاصد الشريعة الإسلامية، وإذا تدخل الحاكم في القضاء أذهب هيبته، وأشاع الفوضى، وعم الظلم، وهدد أمن المجتمع واستقراره، وعليه فلا بد للمحافظة على القضاء من إنشاء هيئة رقابية تحافظ على استقلاله وتمنع أي تدخل في شئونه أو التأثير عليه.
