المستخلص: إن مدى التزام الموظف العام بالقرارات الإدارية غير المشروعة من الموضوعات المهمة في نطاق القانون الإداري، إذ لم تعد السلطة الرئاسية في النظم الحديثة مطلقة، فطاعة المرؤوس لرئيسه ليست مطلقة، وواجب الطاعة لم يعد يعني أن يجرد المرؤوس من شخصيته وينفذ كل ما يصدر من قرارات، فالرئيس لا يملك سلطات مطلقة إنما سلطاته مقيدة بما تفرضه القوانين، فقد يخرج الرئيس من مظلة القانون، ويصدر قرارات غير مشروعة ليخرق بذلك أهم مبدأ من المبادئ التي تقوم عليها الدولة الحديثة، ألا وهو مبدأ المشروعية، وليضع المرؤوس بين أمرين أحلاهما مر عندما يتلقى قرارات إدارية غير مشروعة، فهو إما أن يهدر مبدأ المشروعية ويلتزم بواجب الطاعة، أو أن يهدر واجب الطاعة ويلتزم بمبدأ المشروعية، وقد أثارت مشكلة طاعة القرارات الإدارية غير المشروعة خلافا بين الفقه، وظهرت عدة آراء في هذا الموضوع، ويمكن لنا تلخيص تلك الاتجاهات في عدة نظريات. نتوصل من خلالها إلى مدى إمكانية طاعة القرارات الإدارية غير المشروعة، والنتائج والآثار المترتبة على ذلك.
