|f The continuous operation of the public utility, its susceptibility to change, and equality before it are the three classic principles that govern it and other modern, namely: neutrality, transparency, trust, and efficiency. The beneficiary is the justification for establishing the public utility, and for his benefit, the aforementioned principles that govern the relations between the beneficiaries and the public utility have been established. |a دوام سير المرفق العام، وقابليته لتغير، والمساواة أمامه، هي المبادئ الكلاسيكية الثلاث التي تحكمه، يضاف إليها أخرى حديثة، وهي: الحياد، الشفافية، الثقة والنجاعة. يعد المنتفع مبرر إنشاء المرفق العام، ولصالحه تقررت المبادئ المذكورة، التي تحكم العلاقات بين المنتفعين والمرفق العام، ففي القانون المقارن، إذا لم تقم السلطة المفوضة بإجبار المفوض له على احترام مبادئ المرفق العام، فإن المنتفعين يمكنهم رفع النزاع إلى القضاء ضد السلطة المفوضة.

|d Les lois qui régissent tout service public sont: continuité, mutabilité et égalité. A côté de ces trois principes classiques, il y a d’autres dits nouveaux à savoir : neutralité, accessibilité, transparence, confiance et fiabilité. L’usager est la raison d’être du service public, et c’est dans son intérêt qu’ont été mis en place les fameux principes précités, qui sont les règles régissant les rapports entre usagers et services publics. En droit comparé ,si l’autorité délégante ne contraignait pas son délégataire à respecter les principes applicables aux services publics , Les usagers peuvent engager un recours contentieux à destination de l’autorité délégante.
