| 520 | |b Most foreign investment protection agreements require that foreign investors receive fair and equitable treatment, but the content of this standard is far from being precisely defined. The standard needs to be especially clarified during the disputes between States and foreign investors, this arduous task falls to the arbitrators of the arbitral tribunals, which in their majority choose to use the concept of protection of the legitimate expectations of the foreign investor as a useful criterion to define this standard. | ||

La norme a besoin d’être clarifie surtout lors de différents entre Etats et investisseurs étrangers, cette tâche ardue revient aux arbitres des tribunaux arbitraux qui dans leurs majorités choisissent de recourir à la notion de protection des attentes légitimes de l’investisseur étranger comme critère utile pour définir cette norme. | ||
