"تناول هذا البحث مفهوم السياسة الشرعية باتجاهيها، القائل باقتصار السياسة الشرعية على الشرع المغلظ، كتغليظ بعض العقوبات في باب الجنايات، وكتغليظ بعض الأحكام في بعض أبواب الفقه كتضمين الصناع وغيرها، والاتجاه الآخر القائل بامتداد السياسة الشرعية إلى أبواب الفقه الأخرى، فيجعل السياسة فقه تطبيق للواقع يراعي المصالح ولا يقتصر على التغليظ فحسب، بل يحتمل التغليظ أو التخفيف أو وضع التدابير المصلحية وفق أسس السياسة والفهم الكلي للشريعة، وقد خلص الباحث من خلال دراسته إلى ترجيح الاتجاه الثاني القائل بأن السياسة الشرعية تدخل جميع أبواب الفقه الإسلامي، ولا تقتصر على التغليظ في تلك الأبواب فحسب بل تمتد لتشمل تطبيق الأحكام الشرعية المنصوص عليها أيضا مع الالتفات إلى مناطها الخاص ومآل تطبيقها. كما تناول الباحث مثالا على عموم السياسة الشرعية في أحد أبواب الفقه، وهو: كتاب السير عند الفقيه الشافعي الخطيب الشربيني من كتابه (مغني المحتاج إلى معرفة معاني ألفاظ المنهاج) كنموذج للتدليل على إعمال الفقهاء للسياسة في غير باب العقوبات، وأنها ليست مقتصرة فقط على الشرع المغلظ؛ بل هو تعامل مصلحي لمعالجة الوقائع بما يضمن الوصول إلى المقصود الذي طلبه الشارع سبحانه، وقد خلص الباحث أيضا من خلال هذه الدراسة إلى عمق الشخصية السياسية عند الشربيني من خلال بناء بعض الأحكام أو تعليل بعضها الآخر على أسس السياسية الشرعية."
"This research dealt with the concept of Shariah policy with both tendencies; one of which means that Shariah policy is limited to strict Sharia law, such as toughening some penalties in the field of crimes and making some provisions strict in some sections of jurisprudence, such as amercement for manufacturers, etc. The second view is to extend the Shairah policy to other sections of jurisprudence. It makes the policy a jurisprudence that applies reality that takes into account interests and is not limited to strictness but bears strictness, easiness, or develops conciliatory measures in accordance with the principles of policy and a full understanding of Sharia law. Through his study, the researcher concluded that the second view is more acceptable, which is that Shariah policy enters all sections of Islamic jurisprudence. It is not limited to toughening these sections only but extends to the application of the stipulated Shariah provisions while paying attention to their specific context and the results of their application. The researcher also discussed an example of the generality of the Shariah policy in a chapter of Jurisprudence. It is the chapter of biographies in the book ""Mughni al-Muhtaaj ila Ma'rifati Ma'ani Alfaadh al-Minhaaj"" by imam Al-Khatib Ash-Shirbini as an example of signifying the works of scholars of Jurisprudence of policy in non-penalty chapters.
