المستخلص: يأتي هذا البحث بغرض التعرف على خلاف الأصوليين في تخصيص العموم بقول الصحابي وآثاره الفقهية، وقد اتبع الباحث في كتابة هذا البحث منهج التوسط بين الإطناب والاختصار مع توضيح ما خفي من كلام العلماء في هذه المسألة قدر الإمكان، وحرص على الرجوع إلى المصادر القديمة والحديثة في علم أصول الفقه، مع الاهتمام بنسبة الأقوال إلى أصحابها، وتخريج الآيات والأحاديث النبوية الواردة في البحث. وقد خلص البحث إلى مجموعة من النتائج منها: أن التخصيص عند الحنفية يختلف تعريفه عن التخصيص عند الجمهور، وأن المراد بقول الصحابي: هو ما نقل إلينا وثبت لدينا عن أحد أصحاب رسول الله صلى الله عليه وسلم من فتوى أو قضاء في حادثة شرعية لم يرد فيها نص من كتاب أو سنة ولم يحصل عليها إجماع، وأن خلاف الأصوليين في جواز تخصيص العموم بقول الصحابي الراوي للحديث على ستة أقوال، والراجح منها هو عدم جواز تخصيص العموم بقوله، وقد ترتبت آثاراً فقهية كثيرة على خلاف الأصوليين في هذه المسألة.

This research indicates the purpose of identifying the disagreement of the fundamentalists in the generalization of the words of the Companion and its jurisprudential effects. In the science of jurisprudence, with attention to the ratio of sayings to their owners, and the graduation of verses and hadiths of the Prophet contained in the research. The research concluded a set of results, including: The definition of singling out according to the Hanafis differs from singularity according to the majority, and that what is meant by the companion's saying: It is what was transmitted to us and proven to us from one of the companions of the Messenger of God, peace and blessings be upon him, of a fatwa or judgment on a legal incident in which there is no text from the Book or the Sunnah and there is no consensus on it, and that The disagreement of the fundamentalists in the permissibility of singling out the general by the saying of the companion, the narrator of the hadith is based on six sayings, and the most correct of them is the inadmissibility of singling out the general with his saying, and there have been many jurisprudential effects in contrast to the fundamentalists in this issue.
