المستخلص: تعد الرقابة القضائية على دستورية القوانين واللوائح أكبر ضمانة ناجعة للشرعية الدستورية وإعلاء حكم الدستور، وقد أسفر البحث أسفر عن أن رقابة الإغفال تحقق مبدأ التوازن بين السلطات لصالح المشروعية الدستورية. فضلا عن تحقق الموازنة بين إعلاء حكم الدستور وتحقيق مبدأ سموه وبين المحافظة على الاستقرار داخل الدولة. بيد أن رقابة المحكمة الدستورية العليا لا تقف عند رقابة نشاط المشرع الإيجابي، بل امتدت إلى نشاطه السلبي أيضا، وأن الرقابة القضائية على الإغفال التشريعي تعد أحد أهم أدوات تعديل مسار انحراف المشرع بالسلطة. وقد أوصت الدراسة بضرورة تعديل الدستور المصري بإضافة نص يقرر مسئولية الدولة عن أعمال السلطة التشريعية كبديل لرقابة الإغفال الكلى في حالة إطلاق سلطته التقديرية التي قد تصل في الحقيقة إلى انحراف وتعسف في استعمال السلطة.

Le contrôle judiciaire de la constitutionnalité des lois et règlements est la garantie la plus efficace de la légitimité constitutionnelle et du respect de la règle de la constitution. La recherche a abouti à un contrôle des omissions réalisant le principe de l'équilibre entre les pouvoirs en faveur de la légitimité constitutionnelle. En plus de parvenir à un équilibre entre le respect de la règle de la constitution et la réalisation du principe de Son Altesse et le maintien de la stabilité au sein de l'État. Cependant, le contrôle de la Cour suprême constitutionnelle ne s’arrête pas au contrôle de l’activité positive du législateur, mais s’étend également à son activité passive, et ce contrôle judiciaire de l’omission législative est l’un des outils les plus importants pour modifier le cours de la déviation de pouvoir du législateur. L'étude a recommandé la nécessité de modifier la constitution égyptienne en ajoutant un texte qui établit la responsabilité de l'État pour les actions de l'autorité législative comme une alternative à la surveillance de la négligence totale en cas de libération de son pouvoir discrétionnaire, ce qui peut en fait constituer une déviation et un abus de pouvoir.

Judicial oversight of the constitutionality of laws and regulations stands as the most effective guarantee for constitutional legitimacy and the preservation of the rule of the Constitution. The research concludes that oversight of omissions contributes to achieving a balanced distribution of powers in support of constitutional legitimacy. This oversight balances the preservation of the Constitution's rule and ensures the supremacy of its principles, maintaining stability within the state. Moreover, the role of the Supreme Constitutional Court extends beyond monitoring the positive activities of the legislator to encompass oversight of their negative activities. Judicial scrutiny of legislative negligence emerges as a crucial tool for redirecting the legislator when deviating from their powers. The study recommends amending the Egyptian Constitution by incorporating a provision that underscores the state's accountability for the actions of the legislative authority. This would serve as an alternative to addressing complete negligence in the event of the arbitrary exercise of authority, which may indeed amount to deviation and abuse in the use of such powers.
