تتناول هذه الدراسة الوساطة وفقاً لقانون الوساطة لتسوية النزاعات المدنية الأردني رقم (37) لسنة 2003، فقد عالجت مفهوم الوساطة، ومميزاتها، وأنواعها، ومهام الوسيط وصلاحياته، والإجراءات الواجبة الإتباع من الأطراف والوسيط عند القيام بأعمال الوساطة، وآلية انتهاء الوساطة. وقد اتضح من خلال هذه الدراسة أن المشرع الأردني قد أخذ بمفهوم الوساطة التي تتم بعد قيد الدعوى أمام المحكمة، ويتم إحالتها للوساطة التي تمثل دائرة قضائية داخل محكمة البداية. ولم يعالج الوساطة الاتفاقية التي تتم بين الأطراف خارج النطاق القضائي، وقبل قيد الدعوى. كما توصلت الدراسة إلى اقتراح بعض التعديلات على قانون الوساطة.
This study deals with the concept of mediation of settling civil disputes, its advantages, disadvantages, types; judicial, private, and contractual mediations according to the Jordanian Mediation Law of Settling the Civil Disputes No. (37) 2003. It, also, deals with the tasks and the authorities of the mediator, the procedures that should be followed by both the mediator and the parties during the performance of the mediation tasks and the mechanism in which the mediation reaches its end. However, the Jordanian Legislator have, only, considered the judicial mediation that is to be held upon the registration of the case before the court in order to be transferred to the mediation centre inside the court of first instance. Therefore, the Jordanian Legislator has not considered the contractual mediation which is .to be held outside the judicial system and prior to the registration of the case before the court. However, this study shows the needs of making the necessary amendments to the Jordanian Mediation Law of Settling the Civil Disputes.
