المستخلص: تتناول هذه الدراسة مسؤولية عضو هيئة التدريس المدنية بشقيها المسؤولية العقدية والمسؤولية التقصيرية، حيث تتناول هذه الدراسة في المبحث الأول تكييف علاقة عضو هيئة التدريس بالمؤسسة التعليمية، حيث كيفت العلاقة بين عضو هيئة التدريس والمؤسسة الصحفية على أنها علاقة عقدية تخضع لقانون العمل، كما يتناول بالدراسة علاقة عضو هيئة التدريس بالطالب، حيث بينت الدراسة أنه لا توجد أي علاقة عقدية بين عضو هيئة التدريس والطالب، كما تناولت هذه الدراسة في مبحث ثان مسؤولية عضو هيئة التدريس تجاه المؤسسة التعليمية التي يعمل فيها وبالتالي يجب توافر أركان المسؤولية من خطأ وضرر وعلاقة سببية حتى تقوم المسؤولية العقدية لعضو هيئة التدريس تجاه المؤسسة، حيث تم التطرق للالتزامات العقدية الواجب على عضو هيئة التدريس الالتزام بها والضرر الذي قد يلحقه بالمؤسسة التعليمية، كما تطرق المبحث الثالث لمسؤولية عضو هيئة التدريس التقصيرية تجاه الطالب، حيث قامت هذه المسؤولية على ثلاثة أركان وهي الضرر والفعل العلاقة السببية، حيث تناولنا الفعل الصادر من عضو هيئة التدريس أو من الأشياء التي في حراسته وأدت إلى الإضرار بالغير، كما تناول الضرر الذي يصيب الطالب من جراء فعل عضو هيئة التدريس، كما تناول المبحث الرابع دعوى المسؤولية المدنية من خلال تناول أطراف الدعوى والاختصاص القضائي، حيث يكن هناك اختلاف في اختصاص المحاكم وذلك حسب الدعوى المرفوعة على عضو هيئة التدريس، بحيق قد تختلف المحكمة المختصة من خلال رافع الدعوى الذي قد يكون الطالب تجاه عضو هيئة التدريس وقد يكون المؤسسة التعليمية تجاه عضو هيئة التدريس.

This study was about the civil liability of a faculty member, both of contractual liability and responsibility liability. The first issue dealt with the relationship of a faculty member with the educational institution and how to adapt this relationship between a faculty member and the press institution as a contractual relationship subject to the labor law. The study also discussed the relationship between the faculty member and the student. The results of the study showed that there is no contractual relationship between the faculty member and the student. The second issue discussed in this study was the responsibility of a faculty member towards the educational institution in which he/she works. Accordingly, there should be three elements available in this responsibility namely, damage, action and causation to have the contractual responsibility of the faculty member to the institution. In this context, the contractual obligations that a faculty member should abide by and the damage that he/she may cause to the educational institution were discussed. The third topic discussed in this study is the negligence of a faculty member towards the student. This responsibility rests on three pillars, namely, harm, action, and causation. This study dealt with the committed act by a faculty member or from the things in his custody that lead to harm to others. It also dealt with the harm that affects the student because of the action of a faculty member. Finally, the fourth topic that the study discussed was the civil liability lawsuit by dealing with the parties to the case and the judicial jurisdiction when there is a difference in the jurisdiction of the courts, according to the lawsuit filed against the faculty member. The jurisdiction court may differ according to the claimant, who may be either the student against the faculty member or the educational institution against the faculty member.
