520 |a تصدرت وسائل الإعلام في جميع أنحاء العالم أزمة جنوح السفينة البنمية ايفرجفين وهي تسد مجرى قناة السويس على مدى ستة أيام اعتبارا من 23/3/2021 حتى 29/3/2021. وصدر الأمر من محكمة الإسماعيلية الاقتصادية بالحجز التحفظي على السفينة ايفرجيفين. يطرح الباحث مشكلة رئيسية تتمثل في: ما مدى فاعلية نظام الحجز التحفظي على السفينة ايفرجيفين في ضمان حقوق كل من الدائن الحاجز، والمدين المحجوز عليه، والغير؟ يسعى الباحث تحقيق الأهداف التالية: - بيان خصوصية الحجز التحفظي على السفينة في مصر وفرنسا. - إبراز أحكام وقواعد الحجز التحفظي الواردة في قانون التجارة البحرية المصري، وقانون المرافعات ومقارنتها بأحكام القانون الفرنسي سواء الواردة في قانون النقل أو في قانون الإجراءات المدنية للتنفيذ الجبري. - التعليق على الأمر بالحجز التحفظي رقم 26 لسنة 2021 بحري اقتصادي الإسماعيلية الصادر بتاريخ 12/4/2021 الموقع على السفينة ايفرجيفين المتراكبة في البحيرات المرة بالإسماعيلية، ورفض التظلم منه وتأييد الأمر بالحجز التحفظي رقم 26 لسنة 2021. - التعلق على الأحكام الصادرة عن محكمة الإسماعيلية الاقتصادية في الاستئناف رقم 35 لسنة 14 ق اقتصادي الدائرة الاستئنافية بتاريخ 23/5/2021، والدعوى رقم 23 لسنة 14 ق اقتصادي الدائرة الاستئنافية.  |b The media all over the world topped the crisis of the delinquency of the Panamanian ship Evergevin, blocking the course of the Suez Canal from 23/3/2021 to 29/3/2021. The researcher seeks to achieve the following objectives: Statement of the privacy of the precautionary seizure of the ship in Egypt and France To highlight the provisions and rules of precautionary seizure contained in the Egyptian Maritime Trade Law, and the Procedures Law, and compare them with the provisions of the French law, whether contained in the Transport Law or in the Civil Procedures Law for Forced Execution Commenting on the precautionary seizure order No. 26 of 2021, an economic, marine, Ismailia issued on 12/4/2021, signed on the ship Evergevin, which is anchored in the Bitter Lakes in Ismailia, and refused to appeal against it and affirmed the precautionary seizure order No. 26 of 2021 Commenting on the judgments issued by the Ismailia Economic Court in Appeal No. 35 of 14 BC, the Economic Department of the Appeals Chamber, dated May 23, 2021, and Case No. 23 of the year 14 BC, the Economist of the Appeals Chamber.  |d The media all over the world topped the crisis of the delinquency of the Panamanian ship Evergevin, blocking the course of the Suez Canal from 23/3/2021 to 29/3/2021.
