المستخلص: لم تعد مشاريع البناء في وقتنا الحالي آلية بسيطة وسهلة تتم إدارتها من قبل شخص يطلق عليه المقاول كما كانت عليه سابقاً، فالأمر أصبح مختلفاً لاسيما في ضل توسع وتطور المشاريع العمرانية الكبيرة وظهور المجمعات السكنية الضخمة بشكل ملفت للانتباه في العديد من مدن العراق، والتي يتم إنجازها على شكل مراحل متعددة من قبل أشخاص يمتهنون هذا العمل بشكل قانوني على وجه الاحتراف وفقاً لتوجه العديد من التشريعات القانونية، وقد أفرز هذا الاحتراف العقاري ظهور مصطلح أطلق على تسميته المطور العقاري، هذا الشخص الذي وجد ضالته عندنا في العراق في قانون التعديل الثاني لقانون الاستثمار العراقي رقم (13) لسنة ۲۰۰٦ الذي أتاح للمطور ممارسة نشاطاته العقارية التطويرية بناء على هذا القانون، وعلى الرغم من كون هذه الخطوة هي خطوة إيجابية إيمانا بأهمية ما يقوم به في معالجة مناطق السكن العشوائي وتوفير السكن الملائم للعديد من أفراد المجتمع بالتزامن مع أزمة السكن المزمنة في العراق وتعقيداتها التي أظهرت هناك حاجة ملحة بتدخل مهن جديدة تحد من هذه الأزمة أو على الأقل تخفف منها، إلا انه وفي نفس الوقت تعترض هذه الشخصية إشكالات قانونية ومعوقات لا بد من إيجاد مقترحات ومعالجات تشريعية لحلها، لذلك جاءت هذه الدراسة لتسلط الضوء على هذه الشخصية الجديدة في ساحتنا القانونية، من خلال إيضاح مفهومها وأهم التزاماتها العقدية والمسؤولية العقدية المترتبة على نشاطها لاسيما إن المطور العقاري في هذا النشاط يجمع بين صفة البائع والمقاول، هذه الأمور وغيرها ستكون محور هذه الدراسة.

Construction projects are no longer a simple and easy process managed by a person called the contractor as it was before, the matter has become different, especially in light of the expansion and development of large urban projects and the emergence of huge residential complexes in a striking manner in many cities of Iraq, which are being completed In the form of multiple stages by people who legally practice this work as a professional in accordance with the directives of many legal legislations This real estate professionalism showed the emergence of a new personality called the real estate developer, this person who found what we have in Iraq in the Second Amendment Law of the Iraqi Investment Law No. (13) of 2006, which allowed the developer to practice his real estate development activities based on this law, and despite the fact that The fact that this step is a positive step in the belief in the importance of what it is doing in addressing the areas of random housing and providing adequate housing for many members of society in conjunction with the chronic housing crisis in Iraq and its complexities, which showed an urgent need for the intervention of new professions that reduce this crisis or at least mitigate it, At the same time, this character encounters legal problems and obstacles that must be found with legislative proposals and remedies to solve them, so this study came to shed light on this new character in our legal arena, By clarifying its concept, its most important contractual obligations and the contractual liability arising from its activity, especially since the real estate developer in this activity combines the character of the seller and the contractor, these and other matters will be the focus of this study.
